- Council Minutes of 9/2/193 <br />,~* <br />Miscellaneous Business (continued) <br />agree that i the ow it, Council would like to change the zoning. <br />Mrs. Saringer stated that she wanted Mr. Limpert to understand why this <br />legislation would not be forthcoming. Mr. Gateau compared this situation with <br />the problems involved in the rezc3ning of the Wolstein property. At the time this <br />was being debated, we faced the prospect of going to court ~1.thout expert <br />testimony as to the appropriateness of the desires zoning. Mar. Leonard ask~i the <br />Law Director if Westlake he~dn't recently came in after the t sod reaor~ed <br />property. Mr. Gateau replied that they had not rezoned but had put restrictions <br />on where super stores could be built. Also, there is a lawsuit pending in the <br />Supreme Court on that legislation. Mrs. Babas asked. what the procedure would be <br />to get expert opinion on this issue. Mr. Gateau replied that Cocil could ask <br />the city Planning Commission and the Cuyahoga County Pla~saing Cotmdsson to <br />provide information and documentation on how they concluded mat would be an <br />appropriate zoning for that parcel. Mayor Boyle cammexited that if retail and <br />office use were both considered appropriate far this property, it could not be <br />rezo~d to eliminate retail. Mrs. Babas and Mr. Gateau discusae~d the feet that a <br />property owner could be put at a financial disadvantage if hi-s/her property were <br />to be rezoned. Mr. Burns com~ented that Council should keep in mind that office <br />projects can create a greater traffic problem than a retail store becaur~e traffic <br />is concentrated at certain hours of the day rather than throughout the day. <br />Mrs. Saringer scheduled a Building, Zoning. & Development Committee meeting for <br />7 p.m. on Wednesday, September 29. <br />With the agenda being completed and there being no further business to came <br />before Council, President Boehmer adjourned the meeting at 8:53 p.m. <br />~~ aJZ/~~ <br />a~ ~.~ <br />times D.
