<br />MINU7CES CAF THE MEETING OF TIIE COUNCIL <br />~~ OF TAE CITY OF NORTH OLMSTED <br />SEPTEMBER 20,1994 <br />Present: Council Phrlent Boe~mer, Council Members Bahas, Limpert, Lmd, <br />McKay, Musiat, Nashar <br />Also Present: Mayor Boyle (arrived at 8:40 p.m.), Law Director Gareau, Finance <br />Director Burns, Clerk of Council Semen <br />Absent: Council Member Sarmger <br />Council President Boehmer called the meeting to order at 8:05 p.m in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Fledge of Allece <br />to the Flag. <br />The minutes of the meeting of September 6, 1994 were approved as written. <br />President Boehmer made the following announcements: <br />1. Ordinances 94-142, 94-143, 94-144 and 94-145 had been added to the agenda. <br />2. Ordinances 94-116, 94-128, 94-129, 94-131 through 94-142; Resol~ons 94-118, <br />94-122 and 94-126 would be passed under suspension of the rules. <br />3. A pubfic hearing on Resohrtion 94-127, the 1995 tax budget, will be held at 7:15 p.m <br />on Tuesday, October 18. <br />~t <br />Law Director Gareau reported: 1) The cost of settling the Neroni case was $10,000, <br />which leaves $27,000 in the Casualty Loss Fund. Because of the number of rec~-t cases <br />that have been assigned to legal counsel by the insurance carrier, he and Mr. Wonky <br />have asked the insurance company to add an endorsement to the policy ul~ that the <br />Law Department wiIl act as co-counsel on all new cases. In addition, there will be no <br />settlement authority for amounts over $1,000 without approval by the Law t. <br />2) The Law Department received a lawsuit yesterday regarding a defective sidewalk on <br />Walter Road, and it has been sent to Mr. Wilamosky for review. <br />3) Met with the Mayor, Finance Director, Service Director and NOMBL management to <br />review the RTA agrcem~tt. A response wilt be sent to RTA this week. <br />4) A legal opinion was issued to the Planning Commissicm regarding access and the ability <br />of the Planning Co or the City Council to eliminate existing points of access on a <br />roadway. This opinion was rendered with regard to the proposed Water Tower Square <br />
