Council Minutes of S/16/94
vague in regards to the minir~m standards concerning time periods, which appear to be
overly stringent; due process atians, particularly that there is no provision for
developers to be notified in vvrhing if the City Engineer does not approve a stormwater
management plan; no proviaitm for an appeal process; the anusnnt of the performance
bond. The BIA does support the 'on in principle and would like the opportunity to
work with the city on the tec~ucal aspects of the '~. Mr. Bohhnann. replied to
Ms. Rogers statements by sayu-g that it is his belief that a~ meal process is provided to
the Service Director. A.Iso, Mr. B said he took olfiaase that the BIA was coming
in at the eleventh hour to ob,~ect sad had not att+earded any of the ee
concerning this legislation.. Becausee of the problems during the dorm this peat weekend,
he urged Council to pass the legislation as written. If the concerns of the BIA are found
to be valid, the legislation can be amended at a later date.
Eva Haeberle, 4334 Plumwood Drive, spoke on behalf of residents on Phimwood,
Bentley, Oak and Oak Circle with regard to the flooditng caused by the recent worm. Ms.
Haeberle feels that the surcharging that occurred at Mastiek Road caused the flooding in
her neighborhood. She would like this area to be inchuied in the current Phase F sewer
repair program instead of waiting for the 1995 project. Mayor Boyle told Ms. Haeberle
that her neighborhood was a priority area and the city wilt investigate the cause of
flooding. However, he cannot say that Mast~k Road is the problem unfit the investigation
is con~lete. Service Director Bohhnann said that earlier today he had lengthy discussions
with the engineering and sanitary sewer staffs to ditscuss the flood~g problems in this area.
They determined that the choke point at Mastick Roadhad no bearing on the Ph~mwood
area. He said that a ~t a~urtt of work had previously been dose on the min
lines of the sanitary sewer system in this development. Through the dye process, 50 plus
homes have been identified as needing sanidtary and storm sewer repair work. The
administration will ask Council to pass legislation to authorize the expenditure of an
additional three hundred thousand dollars to take care of the lateral problem in this
subdivision. He hopes to inchtde taus work m the Phase F project. The Mayvr was happy
to hear that the problem dial not involve Mastick Road. He warned Ms. Haeberle that the
neighborhood would look like a `~var zone" during the repairs because lawns would have
to be dug up to repair the laterals. However, aft lawns will be put back to original
condition. Mr. Bohhnann said that the repair work will dstninish the problem in this area,
and the residents should see a vast improvement. However, he does feel that additional
work will be needed in the firture.
LEGISLATION
Resolution No. 94-99 introduced by Mr. Limpert was given its third reading.
