Council Minutes of 8/16/94 <br />Hampton, Berkshire and Devon storm sewers empty. The Mayor will also have the <br />Engineering Departrr~t check the videotapes of the area for poss~k breaks in the <br />sewers. The Mayor will notify Mr. Gellert and Council as to the findings of the <br />Engineering Department. <br />Tom and Joy Gdovin, 4334 Dover Center Road, had a foot and a half of sewage in their <br />basement during the storm. They have not had a problem with flood~g since the storm in <br />May of 1989 when they had three feet of sewage in their baser~t. Since that time, they <br />have spent $22,500 to fix the problem. Their home is for sale and they are very digressed <br />with this flooding problem since rt w~ be very c'irzuh to sell the home. Mr. Gdovin does <br />not feel that the problem is r~water because the water drained from leis basement after <br />two hours. Mayor Boyle expla~.ed that the drains do work by gravity and the water <br />flowed back out through the drains. The Mayor asked Mr. B~ to comment on the <br />flooding problems in this area. Mr. Bohhnaan .asked Mr. Gdovin if the sanitary laterals <br />from his home to the street had been repaired as part of the $22,500 work. Mr. Gdovin <br />said `~o." Mr. Bohimann said that the Gdovin's ba~caily have a reverse or flat flow <br />problem. The laterals from the house to the sanitary sewer ~rould flow down; however, in <br />this case, they are basically flat, and perhaps even reversed. Because their baserr~t is a <br />bit deeper than normal, the sarchargigg that occurred on Blossom and Edgepark caused <br />their basement to become a retention basic. The Mayor and Mr. Boha agreed that the <br />lateral directions would have to be repaired. Mr. Bohlrnann said that this area and the <br />Gdovin property was put on the list for the current Phase F sewer repair program. The <br />Gdovin's have been put at the top of the list because of the deplorable chances of <br />their problem Mayor Boyle asked that Mr. Bohi~mann issue the Gdovin's a letter gig <br />that their home will be part of the Phase F repair work and that the Clerk of Council send <br />them a copy of the minutes of this Council meeting. Mr. Bohhnann stated that he slid not <br />believe the Law Director would have an objection to issuing Mr. and Mrs. Gdovim a letter <br />of intent to repair the sanitary and gorm laterals from their home to the street. The letter <br />should state that this work will hopeifulty correct their problem. In answer to a quegion <br />by Mr. Nashar concernir-g liablhy, Mr. Gareau said that the letter should indicate that, as <br />part of the overall city project, eagffieering studies would be conducted to determine what <br />the problem was and come up wkh a design to correct the problem. The city has <br />governmental immunity for the pig and design of sanitary sewers. Mrs. Bahas, who <br />is a Realtor, told the Gdovins that it is possible to sell a horse with a higory of flooding <br />problems. Also, this particular storm had atFected many homes in many cities and had <br />received major coverage m the newspapers. <br />Karla Rogers spoke on behalf of the Building Industry Association located at 6140 West <br />Creek Road, Independence. The Association, which represents residential home builders <br />and developers in Cuyahoga, Lake, Geauga and Ashtabula Counties, requested that <br />Ordinance 94-100 dealing with. the stormwater management practices be referred back to <br />the Environmental Control Comn~tee for further study. The BIA feels that this ordinance <br />is not a cost item but the Association is concerned with regard to the partcailarites of the <br />language and considerations to due process. Some of the concerns fficlude the <br />arbitrariness of the 1/2 acre lots standard requirement; language which is inconsistent and <br />6 <br />
