Council Minutes of 7/5/94 <br />Thursday, July 7, for second reading and passage of this legislation. The Clerk is in <br />receipt of the fiscal officer's certificate. <br />Mrs. Beringer, Chairperson of the Buildmg, Zoning and Development Committee, <br />reported: 1) The committee met on June 22 and in attendance were committee members <br />Nashar, McKay, Beringer; Building Commissioner Conway; t Engineer <br />McDermott; Planning Co member Paul Miller; Archheetural Review Board <br />member Tom Gallagher. The was held to discuss the proposal for A Chad's <br />View Daycare with a playground in the rear of a General Retail District at 24106 Lorain <br />Road. Ms. Nicole Woli; owner of the daycare, Ms. Rogers representing the real estate <br />company, and Mr. Garrish from the management company were also in attendance. A <br />conditional use permit mast be granted for this facfity. A$er a good deal of discussion, <br />the committee identified areas of concern: 1. The location is close to a bar; 2. The size <br />and location of the playground area. No decision was made at the committee meeting; <br />however, Mrs. Beringer requened a traffic report from Assistant Engr Larry Crriffith <br />and a report from Safety Director Carolyn Kesler. The committee again met em this is~e <br />this evening. The committee received reports from Mr. Grath, Mrs. Kesler, and Ann <br />Archibald who is a daycare licensing specialist. The reports indicate there is no problem <br />with the facility as long as certain requirements are adhered to. Committee members <br />Nashar and McKay voted to present the proposal to Council for approval Before placing <br />the motion before Council, Mrs. Sariager stated that she understands mere is a need for <br />daycare facilities but feels that this is not a desirabin location. She feels this facility ~auld <br />not be located within S00 feet of a bar. Mrs. Beringer moved to approve the Child's View <br />Daycare facility at 24106 Lorain Road; second by Mr. Nashar. Mr. Musial asked Mrs. <br />Beringer if there had been a concern about propane tanks being stored in the area. Mrs. <br />Beringer said that the committee did view the site and there is a propane tank and a stack <br />of firewood at the nearby gas nation. The Safety Director will again visit the site to <br />inspect this situation. Mrs. Beringer asked that her motion for approval include the <br />recommendations of the Plaiwing Commission, ARB, Safety Department, Tr~isportation <br />Department and the BZD Committee with ~ecial notice of the concern about the propane <br />tank and firewood. Mr. Garcon noted that daycare facilities had previously bey a <br />permitted use in a General Retail Business District. However, the latest revieicnn of the <br />Zoning Code requires a conditonah use permit for a daycare in the General Retail I~rict. <br />Council is now required to approve the permit. Mr. Limpert felt that use of this privately <br />owned daycare will be amarket-driven decision made by parents. Mrs. Babas ash{ed for <br />confirmation that the children would he transported to and from the facility and that no <br />children would be wandering amund the area. Mrs. Beringer agreed that the c~tildren <br />would be transported to and from the center and that the playground would be enclosed. <br />However, it is her feeling thief the playground size is not adequate. Roll call on the motion <br />to approve the Child's View Daycare with all the recommendations of the Planning <br />Commission, ARB, Safety Departmeast, Tran~ortation Department and BZD Committee: <br />Beringer, no; Nashar, yes; Musial, yes; McKay, no; Lmd, no; Limpert, yes; Babas, yes. <br />The motion passed with four affirmative votes and three negative votes.
