MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MAY 3,1995 <br />Present: Council President Boehmer, Council Members Limpert, Lmd, McKay, <br />Miller, Musial, Nashar, Saringer <br />Also Present: Mayor Boyle, Law Director Gareau, Finance Director Burns, Clerk of <br />Council Semen <br />Council President Boehmer called the meeting to order at 8 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of Allegiance <br />to the Flag. <br />The minutes of the Council meeting of April 18, 1995 were approved as written. <br />Mr. Boehmer announced that Resolution Nos. 95-56, 95-57, 95-58, 95-59 and 95-60 <br />would be passed under suspension of the rules. <br />REPORTS <br />Mayor Boyle: 1) Mayor Boyle presented a proclamation to Dee Evans, a representative <br />of the VFW Ladies' Auxiliary, in recognition of the annual buddy poppy sale. The <br />proceeds of the sale are used exclusively for the benefit of disabled and needy veterans and <br />the widows and orphans of deceased veterans. <br />2) Mayor Boyle congratulated everyone, candidates and voters, who took part in the <br />primary election on Tuesday, May 2. <br />3) Due to the large number of people in the audience who wished to speak about the <br />senior van service, Mayor Boyle said he would submit the remainder of his report in <br />writing to Council. (Please see attachment.) <br />Law Director Gareau: 1) With regard to the second Fox case, an answer has been filed <br />and the Law Department is currently working on a motion for summary judgment. <br />2) The Eliza Jennings case has been appealed again. Across appeal has been filed because <br />the Law Director feels the city is entitled to interest from the date of the announcement of <br />the Supreme Court decision several years ago. Within four or five months, the Supreme <br />Court will make a decision on whether ft will consider this case. <br />3) The Sammon case has been vohmtarily dismissed. This case had originally been filed <br />against a City of Westlake contractor who had treated streets with a substance to control <br />dust. The substance made its way onto North Olmsted streets and a person slipped and <br />fell off of a bicycle.
