Council Minutes of 5/3/95 <br />4) There has been no ruling on the city's motion for summary judgment in the Hughes II <br />case, which is the case dealing with the destruction of public records. <br />Mr. Nashar commented that he supported Mr. Gareau's attempt to obtain the interest due <br />the city from Eliza Jennings. Mr. Gareau stated he felt it was the appropriate and fair <br />thing to do and would probably mean about sixty to seventy thousand dollars for the city. <br />Finance Director Burns: 1) Preparation of the note ordinances for this year's street <br />program has been delayed; therefore, we will need to have two readings at special <br />meetings in order to pass the legislation at the Heart Council meeting. This delay will not <br />have an impact on the bid process for the street projects. <br />Mr. McKay, Chairperson of the Streets & Drainage Committee: 1) The committee met on <br />Apri124. In attendance were committee members Limpert, Nashar and McKay; Council <br />Members Saringer, Musial, Lmd and Miller; Finance Director Burns; residents James <br />Whitmore, Sharon Lepore and Don DeChant. The committee discussed ordinance 95-48, <br />which authorizes the mayor to submit an application to the Northeast Ohio Areawide <br />Coordinating Agency for the city to participate in a state-wide transportation enhancement <br />program to provide mounding and landscaping along a portion of the proposed Crocker <br />Road. The city has agreed to share in the cost ofthe project and future maintenance. This <br />is a second request for funding by the city. The actual funding will occur in 1998 or 1999. <br />The committee also discussed Ordinance 95-50 which is a companion ordinance to 95-48. <br />Ordinance 95-50 stipulates that the city will prepare for the construction and the <br />construction plans and specifications. The Ohio Department of Transportation will <br />supervise the construction and the conformance with the final inspection. ODOT will <br />contribute SO% of the construction costs and 100% of the construction supervision and <br />the cost of the engineering. Upon completion, the city will maintain the right-of--way on <br />the road. <br />2) A second meeting of the Streets & Drainage Committee was held on Monday, May 1. <br />Present were committee members Limpert, Nashar and McKay; Council Members Lind, <br />Miller and Musial; Service Director Bohlmann; reporter Jacqi Templeton; residents <br />William Hayes, Kenneth Hayes and Tom Hampton. The committee discussed and <br />reaffirmed approval of the streets that will be repaired this year, including the addition of <br />Beech Lane. The legislation for the street projects will be passed this evening. <br />Mrs. Saringer inquired whether the committee had discussed the culvert on Maple Ridge <br />and Walter Road which is in need of repair. Mr. McKay and Mr. Lmd said the culvert <br />between Ambour Drive and Maple Ridge had been discussed. After a lengthy discussion, <br />it was apparent that there had been a mis-communication between Mrs. Saringer and Mr. <br />Lind on the identity of the culvert. Service Director Bohlmann cleared up the issue by <br />explaining that the Maple Ridge and Walter Road culvert was not on the capital <br />improvements list because it is an in-house project. If funds are available, the Service <br />Department will repair it this year.
