Council Minutes of 4/4/95 <br />T,~. 3) Mr. Kraft of the North Olmsted Soccer Organization has asked for input on ways to <br />.~ improve the annual tournament held each year around the Fourth of July. Suggestions <br />received by the Mayor will be passed on to NOSO. <br />4) Directors and division leaders continue to meet and discuss the deficit reductions to the <br />appropriations--many innovative ideas have been presented. The legislation will be <br />presented to Council in May. <br />5) The first presentation of the city economic development plan took place on March 16 at <br />Springvale. The Cablevision community channel is running a tape of this presentation. <br />The second presentation, to area developers and Realtors, will take place on April 6. All <br />Council Members are encouraged to attend. Within the next couple of months, the Mayor <br />will be presenting Council with several economic development plans, some of which will <br />require legislative action. <br />Law Director Gareau: 1) The initial payment from Eliza Jennings was due on April 1 but <br />has not yet been received. Because the Court of Appeals did not journalize the decision <br />until March 13, Eliza Jennings has until April 27 to file an appeal <br />2) A check in the amount of $216,000 has been forwarded to the Finance Department for <br />the proceeds of the sale of the "O'Grady" property (for senior residence development) to <br />Mr. Coury. The Finance Director will file a certificate exempting the city from the real <br />property tax that was paid, which will provide an additional $6,000. <br />3) With respect to the second Hughes case involving public records, when the city raised <br />the issue of the Statute of Limitations, they countered by amending their complaint from <br />money damages to a mandamus ordering the city to produce the public records. We have <br />opposed that because the records no longer exist. <br />4) With respect to the second Fox lawsuit, the city has notified the attorney and given him <br />an opportunity to dismiss the case. Since he has not taken that opportunity, the city will <br />file a motion for summary judgment on the bass of sovereign immunity. The city will also <br />ask for monetary sanctions against plaintiff's attorney. <br />5) The Law Department has worked with the transportation union in order to resolve the <br />contract disputes that have persisted for almost a year. The contract will soon be <br />presented to Council. <br />6) The Louis Robinson case was settled in favor of the city; however, they have filed a <br />motion for a new trial not withstanding the verdict. This is usually a precursor to filing an <br />appeal. It is expected that this will go to the Sixth Circuit. <br />7) Two lawsuits have been filed with regard to accidents occurring at the Rec Center. <br />One case involves a referee with the adult hockey program who slipped and fell on the ice <br />and broke his leg. Because the city has ahold-harmless clause in the contract with that <br />hockey league, we are demanding that they pick up the defense costs. The second case <br />involves a person who also fell on the ice and, consequently, has broken ribs. <br />Finance Director Burns: 1) Mr. Burns asked Council to keep in mind that the Internal <br />Service Fund established by Ordinance 95-22 does not, as of now, have a revenue source <br />and no expenditures have been appropriated. This issue will be addressed in the transfer <br />ordinance to be submitted in May. <br />~..~: <br />2 <br />.. ~~ .,~, <br />
