Council Minutes of 3/21/95 <br />Law Director Gareau: 1) The Louis Robinson case has been settled with the jury finding <br />in favor of the city. <br />2) Approximately a year ago, the city was dismissed out of the Fox case involving building <br />inspections. The case went to arbitration, and Mr. Fox was given a monetary judgment. <br />Mr. Fox has re-filed against the city and Realty One claiming negligence. Because the city <br />has immunity by statute, we will ask to be dismissed from the case. If this is not done, we <br />will file a motion for s~zmmary judgment and ask for sanctions under Rule 11. <br />3) The sale on the O'Grady senior housing property will close within the next week. <br />4) The attorney for Eliza Jennings asked that the judgment be paid in four payments over a <br />twelve month period. The Law Director rejected this proposal and suggested that 50% be <br />paid now, interest continue to accrue on the balance and the balance be paid no later than <br />June I, 1995. As yet, no reply has been received. <br />Mrs. Saringer, Chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met on March 1 S and in attendance were committee members McKay, Nashar <br />and Beringer; Council Members Miller and Limpert; Building Commissioner Conway. The <br />committee discussed Ordinance 95-33, which authorizes the adoption of a maintenance <br />code for residential property, In a letter sent to the committee, Safety Director Kesler <br />stated that she and the Building Commissioner felt that the enforcement of a residential <br />maintenance code would require additional stag' for the Building Department which is <br />akeady short-handed. In light of the proposed budget cuts, they felt the adoption of this <br />code would be a burden. The legislation will be held in committee until the budget <br />hearings are completed. However, the committee feels the maintenance code is necessary <br />and will continue to discuss various methods of getting additional help for the Building <br />Department. <br />Mr. McKay, Chairperson of the Streets & Drainage Committee: 1) The committee met on <br />Monday, March 13. In attendance were committee members Nashar, Limpert and <br />McKay; Council Members Miller and Musial; Personnel Director Wilamosky; Service <br />Director Bohlmann. The committee discussed Ordinance 95-30, which authorizes a <br />highway striping project for 1995 between the city and Cuyahoga County. The county <br />will be responsible for striping the main streets, the center lanes and crosswalks; the city <br />will be responsible for striping the residential streets. The legislation is recommended for <br />approval. <br />Mr. McKay, Chairperson of the Legislative Committee: 1) The committee met on <br />Monday, March 13, to discuss the Mayor's appointments to various boards and <br />commissions. No decisions were made because the committee felt it needed more <br />information about the applicants. The information has since been provided. <br />2) The Legislative Committee also discussed Rule 11 of the Rules of Council which states <br />that voting for President of Council pro tem or filbng a Council vacancy can be done by <br />voice or written ballot. Because the Rules of Council provide for other votes to be taken <br />by voice ballot, the committee decided to remove the words "or written ballot" from Rule <br />11. Mr. McKay moved that the Rules of Council be amended by removing the words "or <br />written ballot" from Rule 11; second by Mr. Miller; motion passed unanimously. <br />2 <br />
