Council Minutes of 9/3/96 <br />,,~~ 5) The Law Department is currently working with insurance counsel on the Shopoff case, <br />~~~ which has to do with an individual who slipped and fell in a Recreation Center rest room. <br />Depositions have been scheduled, and the city will file a motion for summary judgment <br />based on recreational immunity. <br />Finance Director Burns: 1) Last Tuesday, the post-audit conference was held with the <br />Auditor of State's office. Subsequent to the response period, the report will be forwarded <br />to Columbus for approval. The report should be released in mid-September. <br />2) The budget for 1997 is on file in the Finance office and the Clerk of Council's office. <br />The General Fund shows revenues of $14,945,000 compared to $14,305,000 for 1996. <br />Total revenue of all funds is $40,213,000. <br />3) On tonight's agenda is Ordinance 96-162, a transfer ordinance that will be discussed in <br />the Finance Committee. <br />4) The bond rating meetings in New York are tentatively scheduled for the week of <br />October 21. <br />President Boehmer announced that a public hearing would be held at 7 p.m. on Thursday, <br />September 12, 1996, on Resolution No. 96-153, the 1997 budget. A special Council <br />meeting will follow the public hearing at 7:15 p.m. <br />Mr. Musial, Chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met to consider Ordinances No. 96-113 and 96-107. Present at the meeting <br />were Council Members Nashar, McKay and Musial. <br />a. Ordinance 96-113 accepts Jacqueline Lane for dedication. This is a new street, and all <br />of the improvements are in and approved by the city, including those for the cul-de-sac. <br />The committee recommended approval. <br />b. Ordinance 96-107 accepts for dedication, as part of the right-of--way along Mill Road, <br />a strip of land about a thousand feet long by ten feet wide owned by Water Tower Square <br />Limited. The land is being donated to the city for widening of Mill Road. The committee <br />had no objections and recommended approval. <br />Mr. McKay, Chairperson of the Streets and Drainage Committee: 1) The committee met <br />on Monday, August 26, to discuss the options for Clague Road. Present at the meeting <br />were Council Members Nashar, Limpert, Saringer and McKay; Service Director <br />Bohlmann; City Engineer Deichmann; 27 residents from Clague Road. Following a <br />previous meeting with Clague Road residents, Mr. McKay had asked the Service Director <br />and City Engineer for alternative proposals to the four-lane proposal. The following <br />information was received: <br />• If Clague Road is improved to three lanes only, it is highly unlikely that any federal, <br />state or county funds would be available. There are not enough turning movements in <br />the third or center lane to meet the maximum design standard of 7,000 vehicles per <br />day for atwo-lane road. Also, the two curves in the road would be a problem in a <br />,,,~ three-lane design. <br />2 <br /> <br />
