Council Minutes of 7/2/96 <br />_ Clarence's existing hall and to construct a new free-standing bookstore be approved with <br />the recommendations of the Planning Commission and Architectural Review board, <br />approval of the Engineering Department, and particularly that of the drainage plans, and <br />that any additional parking shall not be incorporated until the appropriate city approvals <br />are secured. The motion was seconded by Mr. McKay and unanimously approved. <br />c. A revision of the proposal for a front canopy design at the Rini-Rego store on Lorain <br />Road. This was originally approved by the Planning Commission on November 14, 1995 <br />and by the Architectural Review Board in June, 1996. Of primary concern to the BZD <br />Committee was the width of the front drive. Originally, the drive was 25 feet but the <br />proposal was revised to increase the width to 30 feet for safety purposes. Also addressed <br />was a drainage problem located near the dumpster area. It was recommended that an <br />added drain be provided in the dumpster area to connect it to the sanitary drain. The BZD <br />Committee approved the revised proposal. Mr. Musial moved that the Rini-Rego revised <br />proposal be approved contingent on the recommendations of the Planning Commission <br />and Architectural Review Board and approval of the plans by the Engineering <br />Department. The motion was seconded by Mr. Nashar and unanimously approved. <br />d. A proposal to construct an addition joining the showroom and service building at Great <br />Northern Dodge, 26100 Lorain Road. The plan was previously approved by the Planning <br />Commission on July 26, 1994. It was referred back because approvals expire after one <br />year. The BZD Committee approved the proposal but noted that there is a drainage <br />problem in the rear yards of some of the Canterbury Road residences. The necessity of <br />providing for adequate drainage to preclude the flooding of the rear yards was discussed. <br />Mr. Musial moved that the proposal to construct an addition joining the showroom and <br />service building of Great Northern Dodge be approved contingent on the <br />recommendations of the Planning Commission and Architectural Review Board, approval <br />of the Engineering Department and that the city not issue a certification of occupancy until <br />the retention basin has been constructed in relation to Great Northern Dodge proposal <br />number two and the approval of the drainage system for Great Northern Dodge proposal <br />number two be accomplished by the Engineering Department. The motion was seconded <br />by Mr. McKay and unanimously passed. <br />e. A proposal for the construction of a hotel in a Mixed Use District. The hotel will be a <br />Marriott Courtyard on the site immediately adjacent to the Lone Star Steakhouse on <br />Country Club Boulevard. The area was originally zoned for office buildings. After due <br />consideration, the committee gave approval of the proposal. Mr. Musial moved to <br />approve the proposal for a Marriott Courtyard Hotel to be located on Country Club <br />Boulevard, east on the Lone Star Steakhouse, in the Mixed Use District subject to the <br />recommendations of the Architectural Review Board, the Board of Zoning Appeals, <br />approval and recording of the site plan, approval of the Engineering Department and, in <br />particular, approval of the drainage plans by the Engineering Department. The motion <br />was seconded by Mr. Nashar and unanimously approved. <br />f. Ordinance 96-99 provides for a Charter amendment to be submitted to the electors. <br />The amendment is to Article VII, Section 4 (b) of the Charter and would prohibit the <br />Board of Zoning Appeals from granting use variances. It was a unanimous opinion of the <br />BZD Committee that the BZA should be expressly prohibited from granting use variances <br />~'~' from any provision of the Zoning Code relating to the uses which are permitted.
