Council Minutes of 2/6/96 <br />Mr. Tasse's statement that the bike path will not go anywhere, it should be noted that the <br />City of Westlake will have a bike path which will connect to the Metroparks. If North <br />Olmsted had a bike path, it would connect with Westlake's. 3. With regard to the <br />encroachment on properties, it is important to realize that no property will be taken from <br />anyone on Quail Run. The noise wall will be approximately 40 feet from the residents' <br />rear property lines. The additional 15 feet that the bike path would require would not be <br />taken from one side, The noise wall would probably be moved between 5 and 7 feet <br />closer to the residents--placing it about 33 feet from their properly line. Mr. O'Grady <br />said he did not feel this was all that big an issue when the greater common good was <br />considered. 4. Mr. O'Grady said the safety concerns were unfounded. The Police <br />Department has stated that a bike path does not increase crime. In fact, the opposite is <br />true because it is a very restricted area with a 16 to 20 foot wall on either side. 5. The <br />possibility of a wider sidewalk needs to be explored, and more time should be provided for <br />residents to present their opinions to Council. To that end, Mr. O'Grady feh that a <br />decision on Ordinance 96-12 should be delayed. Mr. McKay stated that the ordmance had <br />nothing to do with widening the sidewalk. This legislation speaks to the matter of the <br />city's obligation to pay for the work that has already been done. He believes the city <br />should pay, and it is his understanding that Mr. Bohlmann and other Council members <br />agree. Mr. O'Grady agreed that there were two separate issues, but he does not agree <br />that the city should pay for the removal of the bike path. He said the city did not request <br />the removal but requested a proposal on the cost. Mr. McKay said that Mr. O'Grady was <br />"splitting hairs." Mr. Nashar stated that at a Streets & Drainage Committee meeting Mr. <br />Bohlmann had indicated that there was a verbal agreement with the city, the county and <br />the engineering company. He believes the city should abide by its word and pay for the <br />services. <br />In response to Mr. O'Grady's comments, Mr. Tasse made the following points: L He <br />feels there has been a "failure to communicate." There are hundreds and hundreds of <br />people who are trying to communicate with Mr. O'Grady. With regard to Mr. O'Grady's <br />comment that he did not represent both homeowners' associations, Mr. Tasse suggested <br />that June Whitmore from the West Park-Forest Ridge Association would agree that he <br />did. 2. With respect to Forest Ridge Elementary School, he did not say he represented <br />the school. However, the homeowners have received letters from the school board <br />president, the superintendent, assistant superintendent and Forest School principal <br />expressing agreement with their approach, their concerns and their requests including the <br />removal of the bike path. 3. On January 29, Mr. Tasse spoke to the Westlake City <br />Engineer and he acknowledged that North Olmsted had a `whole different set of <br />geography." Mr. Tasse does not believe the right-of--way encroachment will be only 5 to <br />7 feet. He and other residents will attend the February 20 Council meeting to present their <br />position on this issue. <br /> <br />7 <br />.. .~ ~ >p <br />
