Council Minutes of 10/21/97 <br />Mayor Boyle informed Council that the County Auditor believes the city has been <br />overpaid approximately $330,000 in hotel and motel taxes since 1992. Our Law <br />Department is looking into the matter because of a discrepancy in the state and county <br />law. The hoteVmotel tax in Cuyahoga County funds the Convention Bureau, and the <br />portion returned to the city goes into the General Fund. This should not be confused with <br />the hoteVmotel tax that the city collects which goes into the Hotel/Motel Tax Fund and is <br />committed to the Safety Department. Should it be determined that the funds are to be <br />repaid, the Auditor's office has stated that they do not expect a check for the total amount <br />but rather that arrangements will be made for a repayment plan. <br />Mr. McKay reported for Mr. Musial, Chairperson of the Building, Zoning and <br />Development Committee: 1) A public hearing was held this evening regarding Ordinance <br />No. 97-73, which creates a new chapter of the Zoning Code entitled "Wireless <br />Communications Towers." Resident Dan Dufala attended and distributed an informational <br />packet to City Council. <br />Mr. Lind, Chairperson of the Finance Committee: 1) The committee met on September <br />30. In attendance were committee members Musial, McKay and Lind; Council Member <br />Nashar; Finance Director Burns; Service Director Bohlmann; Safety Director Kasler. The <br />following pieces legislation were discussed: <br />a. Ordinance 97-81, which is a resolution covering the engineering services for a grant <br />proposal for the first phase of the reconstruction of Brookpark Road. The first phase <br />covers approximately one-third of the project from Lorain Road east to Great Northern <br />Boulevard. Three minority contractors submitted bids, and Polytech, Inc. was selected as <br />the best bid. This project is going to be basically grinding and resurfacing, replacing the <br />berms, curbs, and the Bailey and Fleharty storm sewer improvements with 10% <br />participation by the city. The committee recommended approval. <br />b. Ordinance 97-82, which was passed under suspension at the last Council meeting. This <br />legislation provides for the allocation of funds received from the AT&T tower that was <br />installed in Claque Park. Twenty-five percent will go to the Economic Development <br />Fund, and the balance of 75%, $56,250, will go to the Claque Park Fund. The legislation <br />was amended to remove the words "the balance of in the Whereas clause because <br />$56,000 is not going to fund the required balance of the project improvement of Claque <br />Park. The committee recommended approval. <br />2) The Finance Committee met again on October 14. Present were committee members <br />Lind, McKay and Musial; Council Members Nashar, O'Grady; Finance Director Burns and <br />Service Director Bohlmann. The following pieces of legislation were discussed: <br />a. Resolution 97-83, which is a resolution authorizing the Director of Public Service to <br />advertise for bids for 5,000 tons of asphalt and tack coating. This is basically for street <br />repair and in-house resurfacing of streets. The committee recommended approval. <br />b. Resolution 97-84, which authorizes the Director of Public Service to advertise for bids <br />for 2,000 tons of stone. This is a two-year contract, and the stone is used primarily for <br />2 <br /> <br />
