Council Minutes of 10/7/97 <br />~,, Burns. Ordinance 97-77 provides for a new Chapter 929 of the Utilities Code of the City <br />of North Olmsted entitled "Underground Utility and Communications Systems." The <br />purpose of Chapter 929 is to require underground utility and communications facilities <br />including telephone and cable television facilities to be located entirely underground to the <br />fullest extent which is technologically practicable. Additionally, damaged or deteriorated <br />above-ground equipment which is part of an underground utility communication facility <br />shall be timely repaired or replaced. Equipment which is obviously not level or plumb <br />shall be considered damaged or deteriorated. The committee voted unanimously to -adopt <br />Ordinance 97-77. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane, expressed appreciation that the sewer project in his <br />neighborhood is moving along so rapidly. He said that in the short time he has lived in this <br />community he has noted that Council and the Administration have worked very diligently <br />to solve problems typically associated with municipalities. President Pro Tem Saringer <br />thanked Mr. Lambert for his compliment noting that it is not too often that the Council <br />and Administration get such congratulations. <br />LEGISLATION <br />Ordinance No. 97-44 introduced by Mr. McKay was given its third reading. An ordinance <br />adopting a new and revised Section 521.14 entitled "Treelawn and Apron Maintenance" in <br />Chapter 521 entitled "Health, Safety and Sanitation" of the Codified Ordinances of the <br />City of North Olmsted, Ohio. Mr. Nashar moved for adoption; second by Mr. Limpert; <br />motion passed unanimously. Ordinance No. 97-44 adopted. <br />Ordinance No. 97-71 introduced by Mr. McKay on behalf of Mrs. Saringer was given its <br />third reading. An ordinance amending Sections 755.11 and 755.12 of Chapter 755 of the <br />Business Regulation Code of the City of North Olmsted, entitled "Secondhand Dealers," <br />in order to further regulate unattended donations made to secondhand dealers, and further <br />creating a new Section 521.15 of the General Offenses Code of the City of North Olmsted <br />to provide misdemeanor penalties. against individuals who leave donated materials on <br />sidewalks, in parking areas, or otherwise outside of buildings of secondhand dealers. Mrs. <br />Saringer moved for adoption; second by Mr. Nashar; motion passed unanimously. <br />Ordinance No. 97-71 adopted. <br />Ordinance No. 97-74 introduced by Mayor Boyle was given its third reading. An <br />ordinance designating a percentage of revenues derived from the lease of city property for <br />commercial antenna sites to the city's Economic Development Fund, as twice amended, <br />and declaring an emergency. Mr. Nashar moved for adoption; second by Mr. O'Grady; <br />motion passed unanimously. Ordinance No. 97-74 adopted. <br />Ordinance No. 97-75 introduced by Mayor Boyle was given its third reading.
