Council Minutes of 10/7/97 <br />projects to the city's Economic Development Fund, as amended. Mr. Nashar moved for <br />adoption; second by Mr. O'Grady; motion passed unanimously. Ordinance No. 97-75 <br />adopted. <br />Ordinance No. 97-77 introduced by Mr. McKay was given its third reading. An ordinance <br />creating new Chapter 929 of the Utilities Code of the City of North Olmsted, entitled <br />"Underground Utility and Communications Systems." Mr. Musial moved for adoption; <br />second by Mr. O'Grady; motion passed unanimously. Ordinance No. 97-77 adopted. <br />Ordinance No. 97-73 introduced by Mayor Boyle was given its second reading. An <br />ordinance creating new Chapter 1167 of the Zoning Code of the City of North Olmsted, <br />entitled "Wireless Communication Towers," and amending the following sections of the <br />Zoning Code in order to implement the provisions of said new Chapter 1167: Sections <br />1118.01, 1118.02, 1118.03, 1126.06, 1135.01, 1136.04, 1137.02, 1139.01, 1141.02, <br />1145.03 and 1149.03, as amended. <br />Ordinance No. 97-81 introduced by Mayor Boyle was given its second reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into an agreement <br />with Polytech, Inc. to provide engineering services for the design of the Brookpark Road <br />rehabilitation Phase I and declaring an emergency. <br />Ordinance No. 97-82 introduced by Mr. Lind was given its second reading. An ordinance <br />to make additional appropriations for the current expenses and other expenditures for the <br />City of North Olmsted for the year ending December 31, 1997 as amended. Mr. O'Grady <br />moved for suspension of the rule requiring three readings; second by Mr. Nashar. As a <br />matter of procedure, Mr. Musial asked if the legislation could be passed without a <br />committee report. Due to the chairperson's absence, President Pro Tem Saringer agreed <br />to allow Mr. Musial, a member of the Finance Committee, to report on the discussion of <br />Ordinance 97-82.. Mr. Musial; member of the Finance Committee, reported on the <br />September 30 committee meeting with regard to Ordinance No. 97-82: In attendance <br />were committee members Lind, Musial and McKay; Councilman Nashar; Finance Director <br />Burns; Safety Director Kasler; Service Director Bohlmann. The legislation provides for a <br />transfer of 75% of the lump sum payment of $75,000 received from AT&T to the Claque <br />Park Fund. The committee amended the legislation to eliminate the words "the balance <br />of in the Whereas clause. This change will allow the $56,250 to be utilized for the <br />purpose of funding improvements in Claque Park, not for the funding of the balance of <br />improvements. The Finance Committee unanimously voted to recommend passage of the <br />legislation with the amendment. The motion to suspend the rules requiring three readings <br />on Ordinance No. 97-82 was passed unanimously. Mr. O'Grady moved for adoption; <br />second by Mr. Musial; motion passed unanimously. Ordinance No. 97-82 adopted. <br />Resolution No. 97-83 was introduced and placed on first reading by Mr. Musial on behalf <br />of Mr. Lind. A resolution authorizing the Director of Public Service to advertise for bids <br />for 5,000 tons of asphalt and tack coating of city streets, and authorizing the Mayor to <br />contract for same, and declaring an emergency. <br />,k,a~,,.~.x~,~..w.: , ~.~_.w_.~,, .,_ _ .:..~_~,,,,.. <br />
