Council Minutes of 9/2/97 <br />2) Last week an audit letter was prepared and forwarded to the Finance Director dealing <br />with all of the cases and claims that are currently pending. <br />3) Regarding the Moran case, a complaint had been filed with HUD claiming that the city <br />discriminated in housing. HUD has indicated that they are extending the investigation <br />another 90 days. <br />Finance Director Burns: 1) Referring to the Mayor's comments on property valuations, it <br />should be noted that the County Auditor has informed him that the average increase in <br />assessed valuation was 8%. Any resident who received an increase larger than that should <br />investigate the reason. <br />2) When the sewer bills come out each quarter, the Finance Department receives a number <br />of phone calls regarding the bills. In the past, many of the calls dealt with the increased <br />rates. However, this past quarter the calls were substantially fewer in number and more <br />concerned with usage problems as opposed to the rates. We are continuing to look into <br />the possibility of the Water Department billing residents on a monthly basis, but it has been <br />an uphill struggle. <br />3) The audit letter received from the Law Director has been forwarded to the State <br />Auditor's personnel so that they can complete their audit. <br />Mr. Musial, Chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met on August 25. In attendance were committee members McKay, Nashar <br />and Musial; Council members Limpert and O'Grady; Safety Director Kasler; Building <br />Commissioner Conway; Assistant Engineer McDermott. The following items were <br />discussed: <br />a. Resolution 97-60 which authorizes for recording purposes only the Vienna Woods <br />subdivision No. 4 plat. Present ftom Vienna Woods Construction Inc. were <br />representatives Bob Bartel and Dick Kadar. This is a plot of land between Gessner Road <br />and Lorain Road accessible through the Woodside area and involves the creating of 12 <br />lots. The Planning Commission approved this subdivision on June 24, 1997, and we have <br />been advised by the City Engineer that it meets the requirements of the resolutions and <br />ordinances of the City of North Olmsted. Of concern by the committee was the fact that <br />there would be a part of the land area undeveloped between this subdivision No. 4 and the <br />parcel of commercial property fronting Lorain Road, thereby creating a parcel of land <br />which would be landlocked and zoned residential. The committee was concerned that it <br />possibly could ultimately be added to the commercial property which is south of that. <br />However, the committee has now been informed that there will be a declaration of <br />protective covenant on this parcel, which in essence states that the landlocked land can <br />only be used for residential purposes and shall remain as a grassy or landscaped area. <br />However, this declaration of protective covenant has not yet been recorded. The BZD <br />Committee approved the passage of Resolution 97-60. Mr. Musial moved that the Vienna <br />Woods subdivision No. 4 plat be approved for recording purposes only contingent on the <br />recording of the protective covenant. The motion was seconded by Mr. McKay and <br />unanimously passed. <br /> <br />3 <br /> <br />
