Council Minutes of 8/5/97 <br />Finance Director Burns: 1) During the Finance Committee meeting last week, an <br />executive session was held to discuss the Rocky River lawsuit. At that time, he and <br />Assistant Law Director Dubelko presented Council with the facts on the case. <br />2) The $400,000 notes funding the expansion of the Police Station and the <br />Allendale/Carey sewer project were sold at an interest rate of 4%. <br />3) The city has filed with the State of Ohio for tax exemption on the Springvale property. <br />The exemption for the portion of the property that had been in Olmsted Township has <br />been granted, but the portion within North Olmsted is still pending. We have also applied <br />for refunds of the 1995 and 1996 property taxes paid on those parcels. <br />4) The 1996 audit is progressing. The auditors have all requested documents, and they <br />have a draft of the financial statements. The audit should be completed during August. <br />Mr. Musial, Chairperson of the Building, Zoning and Development Committee: 1) The <br />BZD Committee met on July 28. In attendance were committee members Nashar, McKay <br />and Musial; Council Members O'Grady and Limpert; City Engineer Paul Deichmann; <br />Assistant Building Commissioner Rymarczyk. Agenda items were as follows: <br />a. A proposal to rezone Permanent parcel Nos. 236-23-017, 236-24-019 and 236-24-020 <br />from existing A Residence Single District to Single Family Cluster District. The location is <br />south of Butternut Ridge Road adjacent to Springvale Golf Club. The proposal was <br />considered by the Planning Commission on July 8, 1997, and the proposal was turned <br />down by the Planning Commission. The developer appealed the decision of the Planning <br />Commission. Under 1136.14 of our Planning and Zoning Code, Council following receipt <br />of the Planning Commission report and its own review, shall either approve, disapprove or <br />modify the site plan. Council may also affirm any report by the Planning Commission. <br />Present at the BZD meeting representing the development were Mr. Scheefl; Mr. <br />DeLorenzo and Mr. Rock. During the course of the presentation, which lasted <br />approximately two hours including comments by the residents in the audience, Mr. Scheeff <br />pointed out that the property in question could now been handled from another point of <br />view. They now have access to the Land from Columbia Road, and so it appears they have <br />the opportunity to follow one of several avenues: a conventional Cluster development; an <br />A Residence Single District development; a blend of Class A Single District and Cluster <br />development. There were a large number of residents in attendance who raised a number <br />of issues including spot zoning, traffic congestion, an access drive off Butternut Ridge <br />Road and that the proposal was changed from that which was before the Planning <br />Commission. The plans before the committee concerning the A Residence District <br />appeared to be changed from the proposal that was being appealed from the Planning <br />Commission. Further, there seemed to be some confusion that the developer was not <br />permitted adequate recognition at the Planning Commission to address some questions <br />which came up during the Planning Commission meeting. It is to be noted that, if the <br />developer wanted to build Class A Residence Single District homes, the rezoning <br />procedure would not be required. In light of the discussions taken as a whole, the BZD <br />Committee elected to return the DeLorenzo rezoning request from existing A Residence <br />Single District to Single Family Cluster District to the Planning Commission for their <br />further consideration.
