Council Minutes of 8/5/97 <br />5) The fire at the Kings Path Condominiums was the second serious fire of the year. <br />However, once again the community came together to help those in need. We are <br />continuing to receive calls from people offering their help. The city departments of Police, <br />Fire, Service and Human Resources did an admirable job. Safety Director Carolyn Kasler <br />is thanked for her commitment to training of the safety forces. The results of that training <br />have been evident during these two fires. <br />6) The preconstruction meeting regarding the repairs to Stearns Road, south of the I-480 <br />interchange, will be held next week. Hopefully, a timetable will result from that meeting; <br />and, if so, it will be shared with Council <br />7) The Cuyahoga County Board of Health has advised the city that there have been cases <br />of raccoon rabies coming out of Pennsylvania. There have not been any cases reported in <br />Cuyahoga County and surrounding counties; however, there have been reported cases in <br />areas close to Pennsylvania. The best way to combat this virus is to have domestic cats <br />and dogs vaccinated. The County will form a rabies task force to monitor the movement <br />of the virus and to take whatever actions are necessary to stop the spread of the rabies <br />virus. Mr. Musial suggested we use the city cable channel to inform residents about this <br />problem, and the Mayor agreed it would be a good idea to do that and to use our Internet <br />site. <br />8) The city was recently awarded a grant to educate and inform the public about <br />recycling. This grant is being used for an Internet page informing residents on how to <br />dispose of household hazardous materials. <br />Law Director Gareau: 1) The city was successful in the Fattlar litigation, and the costs of <br />approximately $2,000 will be borne by Mr. Fattlar. However, the decision is somewhat <br />confusing because it basically indicates that there was no clear legal duty on the city to <br />retain Mr. Fattlar. Consequently, if the Statue of Limitations has not run, he still has open <br />to him the avenue of filing a declaratory judgment action determining what his rights are <br />under the Charter. <br />2) A lawsuit has been received from Dolphin Construction Company dealing with claims <br />ofnon-payment as a subcontractor. <br />3) Regarding the lawsuit filed by the City of Rocky River against the City of North <br />Olmsted, an answer will be filed and also a motion to dismiss with respect to the Finance <br />Director being personally sued. <br />4) With respect to the Moran lawsuit, even though the city filed a motion to dismiss their <br />administrative appeals claim, there have been motions going back and forth dealing with <br />the various issues of the case. Today we were notified by the insurance company that <br />attorney Bruce Goldstein has been hired to represent the city. <br />5) Today two arbitration briefs were completed, both dealing with on-duty injury. One <br />case deals with a firefighter slipping on a fire engine when he was on a call. The second <br />concerns a police officer who had been cited by the city of violating five pursuit rules <br />when he was allegedly going after shit-skip driver. The officer crashed into a telephone <br />pole, and he is asking that he be given on-duty pay and not have his sick leave or worker's <br />compensation used. Both claims were denied and will go to arbitration. <br /> <br />2 <br /> <br />
