<br />Special Council Minutes of 7/1/97 <br />b. A proposal by Manor Care, 23225 Lorain Road, to construct aone-story building <br />.~, addition and to enlarge the parking lot. Present were Jim Behrend, project manager; <br />Michael Terwilliger, senior project manager for Manor Care Services; Christopher <br />Howard, civil engineer. The Fire Department resolved the concerns regarding the <br />possibility of another access drive. Drainage problems in the area, which appear to have <br />existed for over 20 years, will be addressed by the developer. The City Forester <br />recommended that a number of large trees be saved and indicated an area where additional <br />trees should be planted. On June 10, the Planning Commission approved Manor Care's <br />proposal, including but not limited to, conditions being placed upon them meeting lighting <br />requirements, acceptance of a drainage plan by the Engineering Department and the <br />granting of a conditional use permit. On June 18, the Architectural Review Board <br />considered Manor Care's proposal. During the course of the discussion, the ARB <br />indicated that the awning should be placed above the entrances so as to provide a <br />distinctive look and that the proposed landscaping plan should be reviewed. The board <br />further discussed the removal and replacing of trees. The ARB approved Manor Care's <br />proposal, including but not limited to, conditions on Manor Care providing a landscape <br />plan for approval, a plan regarding the trees for our Forester's approval and an added <br />feature to dress up the entrance-ways. Mr. Musial moved that Council accept Manor <br />Care's proposal to construct aone-story building addition and enlarged parking lot subject <br />to the recommendations of the Planning Commission and ARB and subject to the <br />Engineering Department approving the retention system, both the deletion and addition to <br />the old and the new. The motion was seconded by Mr. McKay. Roll call: Musial, yes; <br />McKay, yes; Saringer; yes; O'Grady, Mr. O'Grady asked if there would be an additional <br />access drive. Mr. Musial said there would not be an access drive. The Fire Department <br />was called in and they advised that, if additional spaces were put in the handicapped <br />parking areas, the fire trucks could get through. Roll call continued: O'Grady, yes; <br />Nashar, yes; Limpert, yes. The motion passed unanimously. <br />c) As a matter of information Mr. Musial noted that on June 5, Manor Care and Ganley <br />were granted a special permit to add to anon-conforming building by the Board of Zoning <br />Appeals. Ordinance 90-125, and Codified Ordinance Section 1123.13 gives Council the <br />right to object within 30 days. He does not believe that Council should object. Manor <br />Care originally met the 50 foot setback. When the setback was changed to 75 feet, <br />obviously Manor Care became non-conforming. As he understands the situation regarding <br />Ganley, the eastern corner of their lot was not in compliance with the 50 foot setback. <br />The crux of the situation is that, if we do nothing within the 30-day time period, then the <br />special permits will go unchallenged and be permitted to go through. <br />d) With regard to Sunnyside, the final issue involves the elevation of the building. <br />Principals present representing Sunnyside were Kirt Frye for Sunnyside and Bob <br />Matakovich, architect. Sunnyside came back with a proposal to BZD to include porticos <br />above the entrances so as to provide a distinctive look, cement reinforced column covers <br />in the front of the building and dryvit on the top part of the building and lower part of the <br />building and the porticos. There was some communication between Bob Matakovich and <br />Mark Yager of the Architectural Review Board. The committee feels what was derived <br />and finally arrived at was an acceptable compromise. Mr. Musial moved to accept the <br />proposal of Sunnyside to construct two additions and renovate the exterior of the building <br />2 <br />
