Council Minutes of 6/3/97 <br />Boyle said the Board of Control had to rely on the documentation given to them. Bonnie <br />Kelly asked why they were denied access to public records. Mayor Boyle explained that <br />the minutes of the Board of Control meeting were not typed. He will not release the tape <br />without the Law Director. Also, he will not release the tape until it has been transcribed <br />because there is no back-up to it. Mr. Gareau said he wanted to assure Mr. Kelly that the <br />Board of Control labored over this decision--they thought long and hard about it. What <br />was in front of them was very detrimental, and they had to make a decision then and there, <br />and they did. Mayor Boyle said he wanted to address the issue of the Board of Control <br />minutes since the accusation has been made that we will not release the minutes. We will <br />not release them the next day. We will do what we have to do to insure the integrity of <br />public records. The Board of Control minutes are proper and are reviewed by the Auditor <br />of State. Mr. Limpert commented that an appointment should have been made so that Mr. <br />Kelly did nat have to wait for 2 1/2 hours to see Mr. Bohlmann. Mayor Boyle said that it <br />was Mr. Kelly's decision to wait for Mr. Bohlmann who was very busy because we had <br />just experienced 26 hours of rain. Mr. Bohlmann could not leave his duties at that time. <br />President Boehmer informed Mr. Limpert that Mr. Bohlmann's secretary had attempted to <br />schedule an appointment for Mr. Kelly, but Mr. Kelly chose to wait. Mayor Boyle said <br />that he would send a copy of the minutes to Mr. Kelly as soon as they were completed. <br />Mr. Kelly again asked why an investigation was not made. He said he spoke to Mr. <br />Bohlmann the week before the contract was awarded and he did not ask for any additional <br />information. Mayor Boyle said it was a valid question. If he allowed directors to review <br />bids and then go to the contractors and tell them where they are short, that would be <br />undue influence. He does not allow the directors to discuss contracts. The contracts are <br />discussed within the Board of Control. Mr. Kelly said he felt it would have been a <br />"courtesy" to contact the low bidder. <br />LEGISLATION <br />Ordinance No. 97-41 introduced by Mayor Boyle was given its third reading. An <br />ordinance authorizing the Mayor of the City of North Olmsted to enter into a lease <br />agreement with AT&T Wireless Communications for land on which to place a monopole <br />antenna, surrounding complex, fencing, landscaping and related equipment at a designated <br />area of Clague Park. (Before making the motion to adopt, Mr. McKay read a letter from <br />Councilman Lind regarding the proposed tower to be placed in Clague Park. Please see <br />attachment.) Mr. McKay moved for adoption; second by Mr. Nashar. Roll call: McKay, <br />yes; Nashar, yes; Musial, no; Limpert, yes, with explanation. Mr. Limpert commented that <br />this was a very complex issue. There are many questions, and the time to debate this has <br />been short. Council has requested information, and in some cases it's been unavailable. <br />Though not important to many of the residents, it's something that should be important to <br />everyone. We do have monopoles now in the city, and we are going to be getting more. <br />The question is: should park land be lost for a commercial venture? It has been <br />repeatedly said that this is not an issue about money, but about control. But with a <br />soaring debt, maybe it's time the city's government starts looking at money. The amount <br />of park land that we're going to lose is less than a volleyball court. He can envision many <br />much needed improvements to our recreation with the hundreds of thousands of dollars <br />11 <br />
