Internal sound proofing will be presented to the Building Department <br />' and no permit shall be issued until it is approved by the Building Department for proper <br />sound deadening effect and the Fire Department for flame retardation. <br />c. Storage of cars. There shall be no storage of cars. Cars can be stored overnight only <br />as an in-and-out situation. <br />d. Parking--3 cars in front, 8 on the side and 1 in the rear. <br />e. Waste oil removal shall take place during business hours. <br />f. The conditional use permit will be valid for only one year and that any concerns of <br />affected residents be addressed before the conditional use permit is renewed. <br />The motion was seconded by Mr. Nashar and unanimously passed. <br />4) A proposal to construct a baseball diamond on the site of Birch School. Present were <br />Ken Hirz, treasurer of the Hot Stove Association; Dean Brooks, president of the Hot <br />Stove Association; Carol Koziol and Scott Osiecki and Neil Schultz, residents. The <br />committee addressed the concerns of the nearby residents. These concerns involve the <br />close proximity of the ball diamond to the property line of the residents, safety of the <br />children and excessive dust in the air. Extensive discussion ensued regarding the location <br />of the ball diamond 100 feet from the property, watering of the ball diamond, removal of <br />any installed structures in the event that the ball diamond is no longer used, port-a-potty <br />problems and fencing. It is to be noted that the entire diamond is being donated to the <br />City of North Olmsted by the Hot Stove Association. The cost would be approximately <br />$10,000 and because of the growth in the number of children playing baseball more ball <br />diamonds are needed in North Olmsted. Mr. Musial moved to approve the building of a <br />ball diamond and related stntctures at Birch School property on a conditional use basis for <br />one year and further conditioned on: <br />a. That the ball diamond be moved from its currently shown location at least 20 feet to <br />the east and not less than 140 feet from the property line of residents. <br />b. That no structure be constructed closer than 120 feet from the residents property line. <br />c. That, if the conditional use is not renewed, any installed structures shall be removed. <br />d. That any port-a-potty be secluded, screened and secured. <br />e. That an appropriate water line be installed for watering down the ball diamond field. <br />f. That the ball diamond field be watered down before the field is dragged. <br />g. That the ball diamond field be watered down during adverse dry conditions. <br />h. That residents living immediately adjacent to the property upon which the ball diamond <br />is positioned be notified to the extent legally required as to any review of the continuing <br />conditional use permit by the Planning Commission or the BZD Committee of Council as <br />appropriate. <br />i. That the issue of fencing/tree landscaping be addressed during the hearings of the <br />renewal of the conditional use permit. <br />j.
