Council Minutes of 2/5/97 <br />possibility of flooding occurring on the site because of a French drain system and an <br />intricate drainage system involving three tanks with pumps. The landscape plan was <br />approved. The BZD Committee unanimously approved the proposal. Mr. Musial moved <br />to approve the proposal for Chesapeake Bagels subject to the recommendations of the <br />Board of Zoning Appeals, Architectural Review Board, Planning Commission and the <br />Engineering Department with emphasis that the French drain be operating as intended and <br />that the Engineering Department be provided with a certificate that the tank pumps are <br />operational and further that any signage be submitted to the city for approval. The motion <br />was seconded by Mr. Nashar and unanimously approved. <br />Mr. McKay, Chairperson of the Environmental Control Committee, reminded everyone <br />that the committee would hold a public hearing on Thursday, February 6, at 7 p.m. to <br />discuss the radioactive waste storage issue. <br />Mr. Limpert did not have a committee report but had some comments on the Recreation <br />levy that was passed on Tuesday, February 4. He is pleased that the levy did pass. With <br />the passage of the levy, not only will North Olmsted be able to maintain the current <br />facilities and services, but it will give the city a great groundwork for expanding the <br />facilities and the programs. Mr. Limpert did express concern that the election was not <br />given enough exposure. Some residents complained to him that the election was "secret" <br />or "stealth." He felt that the cable access channel and the N.O.tifier could have been used <br />to publicize the levy. It is his hope that the library issue which will be on the May ballot <br />will be very open and informative so that voters will come away from the polls feeling that <br />they've known what they voted for and that they are comfortable in their decisions. Mr. <br />O'Grady asked the Mayor if his understanding is correct that the city cannot spend money <br />to lobby for or against a certain issue. Also, it is his understanding that the election notice <br />was posted twice in a newspaper legal ad. Mayor Boyle said that Mr. O'Grady was <br />correct, and it is illegal for the city to spend taxpayers' money in support or opposition of <br />a levy. And we did not do so. The committee which promoted the levy had to rely on <br />individual donations, and the Mayor personally donated most of the funds. Because of the <br />limited funding, the committee had to target its mailings and could not afford acity-wide <br />mailing. He noted that he did speak openly about the issue to all the reporters, and it was <br />reported in the newspapers. As to the N.O.tifier, the city has taken the position of keeping <br />all elections or controversial issues out of the newsletter--it is used for informational <br />purposes. Mr. Limpert said he totally agrees and understands the law. He just felt that <br />the N.O.tifier could have been used to inform the residents that the issue was going to be <br />on the ballot. Mr. Burns noted that the levy election was mentioned in a Plain Dealer <br />article on Tuesday morning. Also, on Tuesday morning he heard a radio broadcast in <br />which the levy issue was mentioned. <br />Mr. O'Grady, Chairperson of the Intra-Governmental Relations and Legislation; Long- <br />Range Planning Committee: 1) A public hearing, chaired by Human Resources Director <br />Copeland, was held on January 29 to discuss the Community Development Block Grant <br />program.
