MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />NOVEMBER 4, 1998 <br />Present: Council President Saringer, Council Members Gareau, Kasler, Limpert, <br />McKay, Miller, Nashar, O'Grady <br />Also Present: Mayor Musial, Law Director Gareau, Finance Director Copfer, Clerk of <br />Council Seman <br />Council President Saringer called the meeting to order at 8:05 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />Mrs. Kasler moved that the agenda be amended to include Ordinance 98-110 on second <br />reading. The motion was seconded by Mr. McKay and unanimously passed. <br />The minutes of the Council meeting of October 20, 1998 were approved as written. <br />REPORTS: <br />Mayor Musial: 1) A Veteran's Day ceremony will be held at 1:30 p.m. on Wednesday, <br />November 11. The ceremony will begin in front of City Hall, proceed to Old Town Hall <br />for a flag raising and then move to the Police Station where a tree will be planted in <br />memory of Officer Monty Plocica. Mr. O'Grady will speak on the significance of <br />Veteran's Day and the Mayor will speak about Officer Plocica and present a <br />proclamation to the Plocica family. <br />President Saringer reported that Ordinance 98-125 and Resolutions 98-129 and 98-133 <br />would be passed under suspension of the rules. <br />Law Director Gareau: 1) Within the last two weeks, the Law Department has updated the <br />Auditor of State regarding pending litigation within the city. <br />2) The department is currently working on a reply brief dealing with the Rocky River <br />court's determination that the city tree ordinance is unconstitutional. The case is <br />currently in the Eighth Appellate District. <br />3) The department is working on two small collection cases. The first is against a <br />business called Scuba Junction that rented time at the Rec. Center for giving classes. <br />They filed a motion to dismiss, and the city will file a brief in opposition. The second <br />case involves an automobile accident that occurred at the corner of Columbia Road and <br />Lorain Road in which a fire hydrant was destroyed. ($3,500 damage.) The city has filed <br />suit against both individuals, and there are now cross-claims going back and forth. <br /> <br /> <br />
