Counci! Minutes of 11/4/98 <br />monies until they know what the city is going to do with the properties. They will <br />probably back out of their contracts. The contracts do contain several contingencies <br />which include city approval and zoning approval. They feel they have a good plan that <br />would do well for the community. But if the moratorium goes forward, they will <br />probably exercise their rights to end the contacts. Their client will probably not want to <br />sit around and wait. The owners of the property will suffer because their tenants will not <br />want to renew leases. They had planned to work with the tenants who are under long- <br />term leases to reimburse them and to help them relocate within the community. Mrs. <br />Kasler said her understanding of the legislation is that it will provide the city time to <br />examine the area and that no decision has actually been made as to what to do with it. <br />The moratorium will keep things in place so that a decision can be made. She asked Mr. <br />Weinberger what time period would be acceptable for a moratorium, perhaps three <br />months? Mr. Weinberger said they have a variety of contracts with a variety of time <br />periods. They were going to try to get on the Planning Commission agenda very soon <br />because some of the contracts were signed earlier than others. There is still one contract <br />to be signed. Also based on some preliminary feedback from Building Commissioner <br />Conway, they may need some additional land. It is a complicated matter. Anything <br />beyond a few days or a week is really going to be detrimental to what they are trying to <br />do. Also, it sends a certain "flavor" to them. Their plan calls for demolition of the <br />existing buildings and complying with the various setbacks of the city. It will require <br />certain variances. They are trying to work with the Building Department to ascertain <br />how they can best improve the site for everybody and meet the requirements of the city <br />and also satisfy the neighbors. They have a good track record in various Cuyahoga <br />County communities. Mr. McKay asked if they had officially applied for any permits, <br />and Mr. Weinberger said they had not. <br />LEGISLATION <br />Resolution No. 98-106 introduced by Mayor Musial was given its third reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for <br />improvements in Brookpark Road (Phase 2) from Great Northern Boulevard to the <br />easterly corporation line as detailed in the plans and specifications on file and authorizing <br />the Mayor to contract for the same, and declaring an emergency. Mr. McKay moved for <br />adoption; second by Mr. Nashar; motion passed unanimously. Resolution No. 98-106 <br />adopted. <br />Mr. Limpert moved that Council adjourn into an executive session to discuss a possible <br />pending legal matter based upon comments that had been made.
