Council Minutes of 9/1/98 <br />Law Director Gareau: 1) A pre-trial hearing regarding North Olmsted Landholding vs. <br />the City of North Olmsted was held before Judge Mann in Common Pleas Court. The <br />issue is still not resolved, and we are attempting to have that issue stayed while the Rocky <br />River Court case is in the Court of Appeals. <br />2) On August 25, a status hearing regarding the Chamber of Commerce case was held <br />before Judge Nugent in the Federal District Court. An additional hearing is set for <br />December 1, and discovery has been extended until that time. <br />3) The lawsuit filed by the family of the gentleman who committed suicide in the city jail <br />has been turned over to our insurance carrier. <br />4) He would like to discuss the possible settlement of the William Prest case with Council <br />in executive session. <br />5) The AFSCME Service contract negotiations have been concluded, and we are waiting <br />for final verbiage in the collective bargaining agreement. Negotiations with AFSCME <br />Clerical-Technical are continuing. <br />Finance Director Copfer: 1) She will meet with bond counsel this week to finalize the <br />wording in the section of the annual information/offiicial statement which pertains to recent <br />audits. This paperwork is necessary to complete the borrowing. <br />2) Next week she will be dedicating the majority of her time to the 1999 budget, which <br />needs to be passed by Council and sent to the county by the end of September. <br />3) The funds that Mr. Gareau has requested for defending cases will be in the <br />appropriation transfer ordinance next Council meeting. <br />Mr. Nashar, Chairperson of the Public Safety, Health and Welfare Committee: 1) The <br />committee met on August 24 to discuss Ordinance 98-94. Present at the meeting were <br />committee members Miller, Gareau and Nashar; Council President Saringer; Council <br />members Limpert and McKay; directors Gareau, Jenkins, Copfer, Copeland and <br />Bohlmann. The committee discussed the possibility of increasing the penalties and fines <br />for the unlawful parking in handicapped spaces. The legislation will be held in committee <br />for further investigation by the Police Department. <br />2) The committee met this evening to discuss a liquor permit transfer. In attendance were <br />committee members Miller, Gareau and Nashar and Councilman O'Grady. The D2 liquor <br />license of Sunshine Investment Trust, DBA Glitz, 25700 Lorain Road which was in <br />safekeeping will be transferred to George's Marketing Group, DBA Geppetto's, 4967 <br />Dover Center Road. Mr. Nashar moved that Council have no objection to the liquor <br />permit transfer. The motion was seconded by Mr. Gareau and unanimously approved. <br />Mr. Limpert, Chairperson of the Intra-Governmental Relations and Legislation; Long- <br />Range Planning Committee: 1) The committee met on August 24 to discuss Resolution <br />98-96. In attendance were committee members Gareau, Nashar and Limpert and a <br />majority of Council. Human Resources Director Copeland was also in attendance. The <br />ordinance, which will strengthen our citizen participation in the 1999 Community <br />Development Block Grant program, was recommended for approval. <br />,;,~. <br />2 <br />
