MINUTES OF THE PUBLIC HEARING <br />NORTH OLMSTED CITY COUNCIL <br />AUGUST 4, 1998 <br />Present: Council President Saringer, Council Members Gareau, Kasler, Limpert, <br />McKay, Miller, Nashar, O'Grady <br />Also Present: Law Director Gareau, Clerk of Council Seman <br />Council President Saringer called the public hearing to order at 7 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />President Saringer announced that the public hearing was being held with regard to <br />Ordinance No. 98-36, an ordinance creating new and revised Section 1163.12 of the <br />Zoning Code of the City of North Olmsted, in order to permit businesses to be identified <br />on permanent pylon and ground identification signs in business areas containing more than <br />one building, and business buildings containing more than one business unit. <br />AUDIENCE PARTICIPATION <br />Pat Graham, 30217 Hilliard Boulevard, Westlake, Ohio, an employee of Great Northern <br />Dodge and a member of the Chamber of Commerce, said the Chamber of Commerce is <br />pleased that in response to its lawsuit the city is taking action to remedy one of the defects <br />in the "unconstitutional and overly restrictive sign code and make it less harmful to <br />businesses in North Olmsted." The Chamber does not believe the proposed amendment <br />goes far enough and would like the city to open a dialogue with their lawyers to work out <br />a sign code that accommodates both the city's desires and the needs of the business <br />community. The Chamber of Commerce believes the amendment is still unduly restrictive <br />and questions why the proposed amendment is limited to businesses which are set back <br />100 feet from the road or which are on the second floor. The Chamber of Commerce <br />would propose that all plazas be allowed to list the names of all stores within the plaza. <br />Also, they believe that the content of the plaza's identification sign contained in Section <br />1163.12 (h) is not content neutral. The Chamber vigorously objects to the city's attempt <br />to control the contents of signs. <br />Councilman Gareau moved to recess the public hearing until 7 p.m. on Tuesday, <br />September 15, 1998. The motion was seconded by Mr. Limpert and unanimously <br />approved. <br />Law Director Gareau noted that the act of recessing to a date certain is sufficient notice <br />and no other notice of the public hearing will be needed. <br />As there were no further comments, Council President Saringer recessed the public <br />:~. hearing at 7:06 p.m. <br />~f' ~ _. <br />~Lri' <br />t~ <br />arbara L.
