Council Minutes of 6/2/98 <br />volunteers. Mr. Simko and Mr. Nielson were recognized by all present, and they <br />. expressed their thanks for the proclamation. <br />• The S.I.T.E.S. (social involvement through education and service) program at the high <br />school has concluded its seventh year of service. The program is the recipient of the <br />Ohio Best Practices Award. The S.I.T.E.S. students also participated in the North <br />Olmsted Community Volunteer Services Day by completely painting and landscaping a <br />property. Students Eric Harder, representing the 1999 class, and Lynn Pecullis, <br />representing the 1998 class, and teachers Christine Kilbane and Robert Pierce were <br />recognized and presented with a proclamation. The students and teachers were <br />recognized by all present, and they expressed their thanks for the proclamation. <br />Law Director Gareau: 1) When the trees were being decimated on Parcel E, the Service <br />Director, Safety Director, police officers and Building Department personnel all attempted <br />to stop the removal of those trees. As a result, two actions were taken: a criminal action <br />was filed in Rocky River Court; an action was filed in Common Pleas Court to prohibit the <br />removal of the trees. Unfortunately, Judge Gravens of the Rocky River Municipal Court <br />has declared a portion of our ordinance unconstitutional--that portion dealing with the <br />necessity of a permit before trees are removed. He is disappointed with respect to the <br />ruling of the court because he believes anyone in municipal law knows that any ordinance <br />adopted and passed by Council is presumed constitutional. To overcome the presumption <br />of constitutionality is a very, very arduous task. A hearing was never held--it was simply <br />done on briefs. He is looking at an appeal of the decision. <br />2) Regarding the Chamber of Commerce case, Judge Nugent has made some <br />housekeeping rules basically dealing with requests for restraining orders and things of that <br />nature that were wounded by the fact that we had reached agreement to negate those and <br />also adopt a schedule. <br />3) Assistant Law Director Dubelko met with Todd Hunt last week regarding the wireless <br />communication ordinance, which is an overlay zoning ordinance dealing with places that <br />the towers can be located. The ordinance will be introduced soon. <br />4) We were required to choose a factfinder for each unit of AFSCME. The same <br />factfinder was chosen for both. <br />Finance Director Copfer: 1))Semi-annual interest payments on bonded debt outstanding <br />of approximately $57 million, not to be confused with total debt which is approximately <br />$62 million, were paid on June 1 and will be paid on June 15 totaling $1,592,000. <br />2) She has received the response of bond counsel from Mr. Miller's request at the last <br />Council meeting and has delivered it to Council in caucus this evening. <br />3) She has a draft of the April 30 EEA and Revenue reports; however, she did not provide <br />Council with it this evening as she has not had an opportunity to review it. She is <br />concerned because we had some problems late last week and early this week with our <br />system, and she would like to ensure this did not cause information to be lost in batches <br />and also posted improperly.
