~~,~ MINUTES OF THE MEETING OF THE COUNCIL
OF THE CITY OF NORTH OLMSTED
MAY 6, 1998
Present: Council President Pro Tem Limpert, Council Members Gareau, Kasler,
McKay, Musial, Nashar, O'Grady
Also Present: Mayor Musial (arrived at 8:12 p.m.), Law Director Gareau, Finance
Director Copfer, Clerk of Council Seman
Absent: Council President Saringer
Council President Pro Tem Limpert called the meeting to order at 8:03 p.m. in Council
Chambers, 5200 Dover Center Road, North Olmsted, Ohio.
Members of the audience were invited to join Council in reciting the Pledge of Allegiance
to the Flag.
President Pro Tem Limpert announced: Ordinances 98-40, 98-41 and 98-3 would be
passed under suspension of the rule; an executive session would be held to discuss
contract negotiations.
REPORTS
Law Director Gareau: 1) The "sidewalk" case has been settled by the insurance company.
He suggested that the case be settled for no more than $5,000. (The original demand was
for $195,000.)
2) There has been a threat of a taxpayers' action regarding the charging of fees for multi-
family refuse pick-up. These charges have never been implemented, and it does not make
sense to have it in the ordinance to be the subject of a taxpayers' action. It should simply
be repealed.
3) A case management conference with regard to the Parcel E tree issue will be held soon,
and another pre-trial will be held in about a month.
4) A case management conference will be held soon with regard to the Chamber of
Commerce lawsuit with regard to the sign ordinance. A discovery deadline has been set,
and another pre-trial will be held at the end of August.
5) Last week a negotiation meeting was held with the corrections officers. The meeting
lasted for two hours, and a settlement was reached.
Finance Director Copfer: 1) The auditors held apre-audit conference with Council, the
Mayor and Finance Director. This is not an open meeting per the Ohio Revised Code.
2) She is working with the Police Department to verify funds with restricted purposes to
determine availability for potential purchases.
