Counci! Minutes of 5/6/98 <br />Ordinance No. 98-50 introduced by Mayor Musial was given its second reading. An <br />.,; ordinance approving and authorizing the execution of a community reinvestment area tax <br />exemption agreement between the City of North Olmsted and Duke Realty Investments, <br />Inc., and declaring an emergency. <br />Ordinance No. 98-51 introduced by Mayor Musial and the entire Council was given its <br />second reading. An ordinance authorizing the Mayor to enter into an agreement <br />modifying the existing agreement regarding capital charges for sewer improvements <br />between the City of North Olmsted and the City of Fairview Park, and declaring an <br />emergency. <br />Ordinance No. 98-52 introduced by Mayor Musial and the entire Council was given its <br />second reading. An ordinance authorizing the Mayor to enter into an agreement, <br />modifying the existing sewer service agreement between the City of North Olmsted and <br />the City of Fairview Park under which a portion of the City of Fairview Park is served by <br />the city's sanitary sewer system, and declaring an emergency. <br />Ordinance No. 98-53 introduced by Mayor Musial and the entire Council was given its <br />second reading. An ordinance authorizing and directing the Mayor of the City of North <br />Olmsted to enter into an agreement with the City of Westlake for participation by the City <br />of North Olmsted in certain storm sewer improvements located in the City of Westlake <br />that benefit both communities, and declaring an emergency. Mr. McKay moved for <br />suspension of the rule requiring three readings; second by Mr. Limpert. Roll call: McKay, <br />yes; Limpert, yes; Kasler, yes; O'Grady, yes; Miller, yes, with the understanding that the <br />Service Director will work immediately forthwith with the City of Westlake to remove the <br />dam that is in Ehle Ditch that is causing the flooding in the Forest Wood, Laurel Wood, <br />Pine Ridge developments and other developments up and down Dover Center. If <br />Westlake would fail to do so, he would encourage the Law Director to pursue action <br />against the City of Westlake to remove the dam and to receive the water that they are <br />required by law to receive. Roll call continued: Nashar, yes; Gareau, yes. The motion <br />passed unanimously. Mr. McKay moved for adoption; second by Mr. Limpert; motion <br />passed unanimously. Ordinance No. 98-53 adopted. <br />Ordinance No. 98-54 was introduced and placed on first reading by Mayor Musial. An <br />ordinance authorizing and directing the Mayor of the City of North Olmsted to enter into <br />an agreement with Polytech Inc. to provide construction observation services for various <br />capital improvement projects commencing in 1998 and declaring an emergency. <br />Ordinance No. 98-55 was introduced and placed on first reading by Mr. O'Grady. An <br />ordinance creating new and revised Sections 505.02 and 505.08 of Chapter 505 of the <br />General Offenses Code entitled "Animals & Fowl," in order to provide for the impounding <br />of animals causing nuisances in the City of North Olmsted, where their owners cannot be <br />immediately located, assessing costs for the impounding and keeping of such animals, and <br />declaring an emergency. <br />... <br />12 <br />_.._, ,.. _,,. .. ~ ..... ... .. s.a..
