Council Minutes of 3/18/98 <br />3~ <br />Mr. O'Grady added to his committee report: 1) On March 16, the Finance Committee <br />met with the Intra-Governmental Relations Committee to discuss Ordinance 98-15 which <br />deals with the new dues structure for the Westshore Council of Governments. Currently <br />there are two equal portions of the dues based on the population of the city and property <br />taxes. The proposed change recommends that the first 10% of all costs would be split <br />evenly among the six member cities. The remaining 90% of costs would be based on a <br />formula that is 75% based on population and 25% on the valuation for the last available <br />tax duplicate. The committee recommended approval. <br />Mr. Gareau, Chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met on March 11. In attendance were committee members Miller, McKay and <br />Gareau; Council members Kasler, O'Grady and Limpert; Recreation Commissioner <br />Dolansky; Safety Director Jenkins; Assistant Engineer McDermott; representatives from <br />the Hot Stove Baseball organization; several residents. Agenda items were as follows: <br />a. The Katherine Bennet lot split and consolidation plat. This is a proposal to split the rear <br />half of land designated as P. P. 236-07-001 which fronts on Columbia Road and to join it <br />individually to the rear adjacent parcels of 236-07-003, 236-07-063, 236-07-064, 236-07- <br />065, 236-07-066, 236-07-067 all of which front on the north side of Arlington Lane. The <br />zoning is C Residence Single and the proposal conforms to the Zoning Code area and <br />frontage requirements. This is a proposal where there is a narrow parcel of land of <br />considerable length that fronts on the west side of Columbia Road south of Lorain. This <br />parcel of land is a buffer between homes on Arlington and the commercial development on <br />Lorain. The proposal seeks to divide this narrow parcel of land and attach each divided <br />segment to the rear half of residential lots, giving the residents an additional 90 to 110 feet <br />of depth to each individual lot. The Planning Commission approved and the Engineering <br />Department had no objections and the BZD Committee unanimously recommended <br />approval. Appropriate legislation will be prepared. <br />b. Ordinance 98-11, an ordinance creating new Section 1367.11 of the Building Code in <br />order to exempt small satellite antennae from the permit fee requirements of Chapter <br />1367. This matter was previously held in committee pending further Law Department <br />review when the Building Department noted that a conflict between the ordinance and the <br />Ohio Basic Building Code existed. The ordinance seeks to remove permit requirements <br />while the Basic Building Code has requirements for dish antennae more than 2 feet in <br />diameter. This ordinance was drafted to comply with the Federal Communications <br />Commission rules promulgated under the Telecommunications Act of 1996. The FCC <br />rules prohibit municipal ordinances from enacting or enforcing laws or regulations which <br />unreasonably interfere or impair the installation, maintenance or use of certain satellite dish <br />or mast antennae. The City of North Olmsted had a permit fee requirement of $150 to <br />install a satellite dish. This was brought to our attention, and on further analysis, it <br />appeared that the $150 permit fee requirement would amount to an unreasonable <br />interference with the maintenance or installation of the satellite dishes. The problem that <br />Council had was the requirement of the Basic Building Code that these be regulated and <br />'`°~ the federal law that stated they could not be regulated.
