. r <br />,~ MINUTES OF THE PUBLIC HEARING <br />CITY OF NORTH OLMSTED <br />FEBRUARY 17, 1998 <br />Present: Council President Pro Tem Limpert, Council Members Gareau, Kasler, <br />McKay, Miller, Nashar, O'Grady <br />Also Present: Law Director Gareau, Clerk of Council Seman <br />Council President Pro Tem Limpert called the public hearing to order at 7:18 p.m. in <br />Council Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Mr. Limpert announced that the public hearing was being held to discuss Ordinance <br />No. 97-121. <br />There were no comments from the audience. <br />Mr. McKay said that he had some questions that he would like clarified; therefore, he was <br />going to ask that the legislation be returned to committee. Law Director Gareau said he <br />did not recommend that be done because there were three senior citizen housing projects <br />currently pending. He believes that senior citizen housing should be a permitted use in the <br />districts named in the legislation. (One and two family residence district; multiple <br />residence district, apartment; business district.) Mr. McKay said he was concerned that <br />there would be no control on how many units can be placed in one particular location. <br />Law Director Gareau said that there was control because only a certain number of units <br />could be placed on an acre, and the size of the units have to meet the Zoning Code. <br />Council would have the same control as in any situation where a proposal comes before <br />Planning Commission and development plans are submitted. This legislation has gone <br />through the Planning Commission, and to take it off the agenda now would mean the <br />process of notification and a public hearing would have to be done all over again. Mr. <br />McKay asked if it would be possible for a developer to buy up homes in the middle of a <br />housing development and put in senior housing. Law Director Gareau said no because a <br />special use permit would be needed to build senior housing in a single family residence <br />district and the permit has to be approved by the Planning Commission. The legislation <br />will allow senior housing in multi-family districts and business districts as a matter of right. <br />Mr. McKay said he was worried about saturating a particular area with senior housing, but <br />Law Director Gareau did not believe that. would be a problem. Mr. O'Grady asked what <br />the advantage of the legislation would be. Law Director Gareau said the city has a need <br />for senior housing and right now it cannot be built without a rezoning. This issue came <br />about because of a question that had been asked of the Building Commissioner: Would he <br />permit a nursing home to go into amulti-family district that was adjacent to asingle-family <br />district since a nursing home was a permitted use in single family.
