Council Minutes of 10/19/1999 <br />Ordinance No. 99-145 was introduced and placed on first reading by Mr. O'Grady. An <br />ordinance amending for a second time Section 2 of Ordinance 98-32 entitled "An <br />Ordinance Establishing Rates of Compensation for Various Administrative and <br />Legislative Personnel, and Declaring an Emergency," so as to provide a year 2000 salary <br />rate for the new part-time Civil Assistant in the Law Department, and declaring an <br />emergency. <br />Ordinance No. 99-146 was introduced and placed on first reading by Mayor Musial. An <br />ordinance authorizing the Mayor of the City of North Olmsted to negotiate and enter into <br />an agreement with the City of North Ridgeville, Ohio, concerning proposed Cypress <br />Avenue, and declaring an emergency. Mr. Gareau moved for suspension of the rules <br />requiring three readings and committee review; second by Mrs. Kasler. RoII call: <br />Gareau, yes, with comment that initially, when he first received this information and had <br />an opportunity to go over it, he was rather reluctant because oftentimes Council does not <br />suspend the rule requiring three readings for matters they know very little about. <br />Frankly, he felt that he was being pressured in a sense because of a situation that litigants <br />had gotten themselves into out in Lorain County. Being an attorney, he understands that <br />such situations can come about. However, he would have preferred to have had more <br />information in advance of this evening. The representations of all parties involved have <br />been helpful and insightful to him on this particular piece of legislation. He would like <br />his comments from earlier in the meeting and his questions and responses also be <br />incorporated into his response and explanation of his vote. His vote is yes. Roll call <br />continued: Kasler, responded that she joined in Mr. Gareau's comments and voted yes; <br />Limpert, yes; McKay, yes, with the understanding that the resident who occupies the <br />building next to the road will have an opportunity to come before the Planning <br />Commission and express his concern. Otherwise, he would have voted no. Roll call <br />continued: Miller, yes, with comment that he has strong reservations about this plan, <br />particularly given the limited time that Council had to review it. However, after listening <br />to comments from the Law Director, he is assured that he will have an opportunity at <br />another time to vote down this particular roadway if his concerns are not met. Roll call <br />continued: Nashar, yes, commenting that Council's feet were almost held to the fire but, <br />after hearing the discussion, he is voting yes. Roll call continued: O'Grady, no, for the <br />reasons stated by everyone else for voting yes. In order for him to vote for suspension of <br />the rules, he would have to be very comfortable that the right thing is being done. He <br />does not have that level of comfort because the business resident of North Olmsted who <br />will be affected by this was not available to tell Council how he feels about this plan. The <br />motion passed with six affirmative votes and one negative vote. <br />Per the Rules of Council, President Saringer asked if members of the audience wished to <br />address Council on this matter which was being considered for passage under suspension <br />of the rules. <br />Dennis Lambert, 25057 Carey Lane, said he was not speaking in favor or against the <br />ordinance. He was speaking about the etiquette of Council at this particular point. It <br />seems apparent to him that North Ridgeville will not have to pay any fees if they can go <br />to the court and say the agreement is reached, but will have to pay some sort of fees if the <br />13 <br />` ~ <br />
