Council Minutes of 10/19/1999 <br />the mayors of Lakewood, Bay Village, and Garfield Heights. First Energy, the parent <br />company of CEI, Ohio Edison and Toledo Edison, filed their plan on October 5. Under <br />the rules of the PUCO, within 45 days of the filing of the transition plan, as well as <br />supporting direct expert testimony, pursuant to Section 4928.31 Revised Code, interested <br />people and other persons and institutions may file preliminary objections regarding the <br />company's proposed transition plan. The proposal of First Energy contains 7,000 pages. <br />It would not be possible for anyone to effectively and intelligently review these 7,000 <br />pages in 45 days. (The Mayor asked Service Director Bohlmann to bring in the First <br />Energy report. Mr. Bohlmann wheeled in several large volumes on a dolly) He and the <br />other mayors have written the county commissioners, Mr. Schriber of the PUCO and the <br />Mayors and Managers Association of Cuyahoga County to ask that the timeframe be <br />changed so that people will have 90 days after the first of the year to make comments on <br />the proposal of First Energy. <br />Law Director Gareau: 1) The Law Department is preparing for the Parcel E litigation <br />which will go to court next Tuesday. An executive session will be held this evening to <br />discuss this case. <br />2) With regard to the Faia case, where the city was sued for unlawful search and seizure, <br />the insurance company is handling the case in federal court. There was apre-trial last <br />week, and the case was resolved. Under the confidentiality agreement, the exact amount <br />cannot be revealed but it does involve the insurance deductible. <br />3) A pre-trial has been held on the Moran case. The demand currently is $265,000 for <br />refusal to grant a building permit which could not be granted because there was no <br />compliance with the licensing laws of the State of Ohio for that type of facility. The case <br />is set to go to court in August of 2000. <br />4) The arbitrator issued the decision in the case of the Chris Fox dismissal. The award <br />changed it from a dismissal to 90 working days. <br />5) We have received the signed purchase agreement for the second parcel in the industrial <br />park where RTA will build the bus garage. <br />6) The Law Department has worked with the North Ridgeville Director of Law, as well <br />as private Council representing Q-Panel, to come up with an agreement on Cypress <br />Avenue. As some Council members did not have time to ask all their questions during <br />caucus, the matter will be discussed further later in this meeting. Hopefully, Council will <br />feel satisfied that the agreement sufficiently provides protection for the City of North <br />Olmsted yet, in cooperation with the City of North Ridgeville, would provide some safety <br />measures for people using the ingress and egress to a parcel this is going to be developed <br />for commercial purposes. <br />Finance Director Copfer: 1) The August revenue and expenditure reports were <br />distributed to Council this afternoon. <br />2) On Monday, October 18, the 1998 audit report was released by the Auditor of State's <br />office. The city again received an unqualified opinion. <br />3) Tomorrow the department will again test the payroll system upgrade that is necessary <br />to be Y2K compliant. When it was run the last time, there was a glitch. However, the <br />modification which was a part of this problem was looked at again by the software <br />vendor and was reworked. <br />2 <br /> <br />
