Council Minutes of 8/3/99 <br />as single family. However, we have a court decree that indicates that those properties are <br />to be used for hotels, motels and office buildings. If they want to change it at all, they <br />have to come back and negotiate it with the city. If we give approval, then they can use it <br />for that use. That is how Moen became Moen. But for that lawsuit, we would have never <br />had Moen. Those are some of the considerations that you have to look at-this is all a <br />planning issue. We have to make sure that we are guarding the property that abuts single <br />family residential about which we have concerns. As far as the appropriateness for this <br />use, that is a policy decision that has to be made by the administration and Council. <br />There are two separate policies, and the residents are correct in wanting to know where <br />each stands. Presumably, they will be receiving that information at some time in the <br />future although this can't be taken out a long time in the future because the Park-n-Ride <br />presently located at the shopping center is going to be gone in two years and plans must <br />be made. It's an integral part of the transit system and they have to make plans to make <br />sure that they have continuation of that. Mr. Miller said he wished to respond to the <br />Mayor's earlier comment that he doubted Class A residential homes could be built in that <br />area. He pointed out that in Fairview Park at the southeast corner of W. 220' Street and <br />Mastick Road there are two homes overlooking I-480. Also, people in Rocky River and <br />~' <br />Bay Village live very close to railroad tracks. People, for the right price and the right <br />city, will choose to live in a nice house even though it is close to a highway. Mayor <br />Musial said that is true, but the asking price for the property would determine if it is <br />possible to build a reasonable home at a reasonable price. Mr. Miller said it depends on <br />the zoning, and the Mayor agreed. <br />Joe Bouman, 23950 Lessner Road, said he was surprised to learn that Council had held a <br />special meeting on July 5 during their vacation. He wanted to know if anyone knew <br />about the meeting and said he was concerned about Resolution 99-84 which authorizes <br />the Mayor to submit and seek financial assistance from ODOT. He wanted to know <br />whether this seeking and submitting commits the city to the improvements that may be <br />funded through ODOT. Service Director Bohlmann answered that it was discovered <br />right before Council was going to recess that the city had an opportunity to get a grant for <br />~~ a sidewalk program from ODOT. This is an 80/20 program, and the city wanted to apply <br />~"" for it because we do have some inadequate sidewalks in the city and some areas where <br />there are no sidewalks. This program is not restricted to state routes, but does include <br />city streets and residential areas. When we have an emergency situation such as this, <br />Council is asked to suspend the rules in order to pass the legislation allowing the city to <br />go out for the grant. The 20% cost to the city is something that Council can decide later <br />if the grant is received, or Council can choose to reject the grant. The value of the grant <br />is approximately $1.6 million if we receive the entire funding, which means the 20% cost <br />to the city would be approximately $32,000. The urgency was that we had to have the <br />grant application in by July 13 to be eligible for this year. It seemed appropriate to ask <br />Council to suspend the rules in this situation. Mr. Bouman asked if Council's decision <br />would be by ordinance, and Mr. Bohlmann said it would be. On another matter, Mr. <br />Bouman asked why the legislation regarding the dewatering centrifuge for the Treatment <br />Plant was passed under suspension of the rule. He had expected it to be on third reading <br />tonight. He objects to money being obligated on emergency and suspension of the rules. <br />He is also concerned that all these things were done when Council was on vacation with <br />10 <br />~. , .__, <br />
