It was our position that the county or State of Ohio ought to <br />~, <br />pay that cost. <br />4) On July 12, notice was received of a lawsuit against the City of North Olmsted by <br />Timothy DiFranco. Mr. DiFranco was involved in an automobile accident wherein a <br />police officer rear-ended his vehicle on Great Northern Boulevard on an icy winter day. <br />The case has been turned over to the insurance company for defense. <br />5) On July 15, notice was received from the Ohio Civil Rights Commission that an <br />unsuccessful applicant for a job with the city had filed a complaint with the commission <br />charging that the city had refused to hire him because of a perceived disability as an <br />alcoholic. The Law Department is in the process of responding to that charge. <br />6) On July 22 and 23, all three members of the Law Department civil branch attended a <br />two-day municipal law conference in Columbus. <br />7) On July 30, a status conference was held in federal court on the Faia case. This is the <br />individual who brought a 1983 action against the city and police officers in federal <br />district court charging that the city unlawfully searched his house in connection with a <br />911 call. <br />8) August 2, he met with the RTA representatives concerning the status of land <br />acquisition for the new bus garage and informed them that we had reached an agreement <br />with both property owners. We are in the process of preparing the purchase agreements. <br />In turn, RTA is preparing a lease agreement for the lease-back of the property and also a <br />proposed lease whereby the city would lease the garage that would be built. The city will <br />control the land and RTA will construct the building, so cross-over leases are required. <br />9) On August 3, he attended a SERB hearing in Columbus concerning two unfair labor <br />practices filed by the city dispatchers concerning two Police Department policies, the <br />uniform policy and the shift trade policy. Also in attendance were Safety Director <br />Jenkins, Assistant Law Director Carr, Police Chief Ruple and a sergeant from the Police <br />Department. We have a tentative resolution of that, but the details have to be worked out. <br />Mayor Musial reported for Finance Director Copfer: 1) There are twelve pieces of note <br />legislation before Council this evening-eleven are renewals and one is $300,000 of new <br />borrowing for Springvale. The eleven renewals are not required to have three readings <br />and athirty-day wait. However, the Springvale note requires three readings and thirty <br />days before the borrowing can occur. Therefore, this must be passed by Friday, August <br />13. This is an enterprise fund for which the payback is intended to be self-supporting. <br />2) In June, there had been discussion about potentially going out to the bond market in <br />September to take advantage of the portion of the 1992 bond issue that is eligible for <br />refunding. However, the bond market from a seller's perspective is not what it was thirty <br />days ago. The monies that would have been saved by the lower rate have dropped below <br />where it makes sense to do this. <br />3) The appropriations ordinance before Council this evening has both additional <br />appropriations and transfers of appropriations. <br />4) Our software system continues to be plagued by a looping glitch. There were line item <br />transfer budget revisions within control groups requested from departments for May and <br />June which could not be entered. When the first one was posted, the looping process <br />began all over again. Departments were sent through-the-day revenue and expenditure <br />,~, <br /> <br />
