Council Minutes of 8/3/99 <br />approval of the Architectural Review Board. The committee recommended <br />,~, approval. <br />• Ordinance 99-75, which requires the construction or reconstruction of sidewalks in <br />the public right-of--way abutting commercial property when it is in the process of <br />development or redevelopment. The committee recommended approval. <br />AUDIENCE PARTICIPATION <br />Dennis Lambert, 25057 Carey Lane, spoke about three items: <br />1. The bike path on Cedar Point hill, which is under construction and does not contain a <br />walking area. He is afraid there will be nothing but a yellow line to divide the <br />walkers from the riders down that very dangerous hill. Mr. Lambert would like <br />Council to consider some sort of fencing or guardrail for the walkers and the bikers. <br />2. The Park-n-Ride issue was discussed at a public meeting as a zoning issue. He <br />believes that it should be assigned to chairperson Miller's Transportation Committee <br />for investigation. Also, he believes the residents would appreciate having some sort <br />of input or investigation at that level prior to the introduction of legislation. <br />3. He believes motorists who tailgate, especially truckers, have become a very serious <br />safety issue on our streets and highways. Mr. Lambert would like Council to consider <br />legislation concerning tailgating and make sure that it is enforced on the freeways and <br />roads of North Olmsted. <br />President Saringer asked Public Safety Committee chairperson Nashar to consult with the <br />Safety Director on the matter of current laws regarding tailgating. Mr. Nashar agreed that <br />tailgating was a serious issue and not confined to truckers-passenger vehicles are <br />speeding and tailgating also. He will look into the matter to see what enforcement issues <br />can be used to address this. Mr. Miller noted that he had been considering a "road rage" <br />ordinance and has been advised by the County Prosecutor's office that we do have <br />ordinances on the books to address that issue. Motorists can be cited under the fail to <br />yield an assured clear distance ordinances and reckless operation ordinances. As to the <br />matter of the Park-n-Ride, Mr. Miller noted that there was a glitch in notification and he <br />was not informed about the meeting, otherwise he would have been there. On the matter <br />of Cedar Point hill, Law Director Gareau noted that was a county project-designed and <br />constructed by Cuyahoga County. Mr. Lambert suggested that the city might want to <br />fund some sort of guardrail to protect the citizens who walk up and down the hill. With <br />regard to the Park-n-Ride, Mr. O'Grady said he felt there was more to be discussed. As <br />to Cedar Point hill, he agreed there is no room for the walkers/bikers and perhaps the city <br />should inquire about the county's intent. On the tailgating issue, he would defer to the <br />Law Department but believes the laws that are in place should cover the issue. <br />Dave Dillon, 31143 Lily Lane, said two months ago a tree limb came off a tree in his <br />father-in-law's yard and extended across Clague Road. Knowing that getting a tree <br />service to come and take care of it would probably be a long process, he called the <br />Service Department. The Service Department came out and took care of the problem <br />quickly. He wished to commend the Council and the administration and especially the <br />Service Department, which is headed by Mr. Bohlmann, for the nice, fine job they did for <br />7 <br />
