Council Minutes of 8/3/99 <br />Lorain, where the promise was made that they would grade and seed the lot to the <br />south of their current structure. That property contains chunks of concrete in it and <br />y~Y.r <br />there are weeds sprouting all over. Another situation currently being addressed is <br />Developer's Diversified. Anyone that was at the Ward N Town Hall meeting is <br />familiar with the problems at the plazas that were constructed and landscaping not <br />being completed. Lastly, all of Council is familiar with Mr. Baker on Mildred <br />Avenue who is waiting for Manor Care to plant trees they said two years ago they <br />would plant. The committee agreed unanimously that this type of thing has got to <br />come to an end, and we need an ordinance that puts teeth into our own building codes <br />if they are being ignored. As amended, deviations from approved plans will now <br />result in a $100 per day fine for the first five days and $250 a day for every day <br />thereafter. Each day would be a separate offense under our code. The Building, <br />Zoning and Development Committee agreed that this would provide incentive for <br />developers to carry through on their promises and representations that they make <br />before our boards and commissions. After discussion, the committee recommended <br />approval of Ordinance 99-82 as amended. <br />• Ordinance 99-83 was referred to committee at the last Council meeting; however, it <br />was not discussed and remains in committee at this point in time. <br />Mrs. Saringer asked Mr. Gareau if the Building Department inspectors could make sure <br />that the promises are enforced. Mr. Gareau stated that the inspectors have been working <br />on these issues and they have involved the Law Department with respect to Developer's <br />Diversified. Unfortunately, it comes down to the fact that we have to go to court to get a <br />restraining order every time we run across these matters. We do not have the appropriate <br />criminal remedy whereby we could file a complaint in Rocky River Municipal Court as <br />opposed to drafting a complaint with a restraining order and going to court in downtown <br />Cleveland every time this comes up. Being able to cite the offenders in Rocky River <br />Court will make the process more workable. <br />Mr. Nashar, chairperson of the Public Safety, Health and Welfare Committee: 1) The <br />committee met on June 21. Present were committee members Miller, Gareau and <br />Nashar; Council member O'Grady; Safety Director Jenkins. The committee discussed <br />Resolution 99-73, introduced by Councilman Miller, which supports Senate Bill 142 <br />which will provide tougher penalties for assaults upon law enforcement officers. The <br />committee strongly recommended approval. <br />Mr. McKay, chairperson of the Streets & Drainage Committee: 1) The committee met on <br />Monday, August 2. Present were committee members Nashar, O'Grady, McKay; <br />Councilmen Limpert and Miller; Service Director Bohlmann; City Engineer Deichmann. <br />The committee discussed: <br />• Ordinance 99-67, which amends the methods and materials for treelawn brickscapes <br />of commercial buildings. The amendment will still include the brick pavers and also <br />permit concrete simulating brick pavers as recommended by the City Engineer. The <br />committee amended the ordinance to include the use of earth tone colors and the <br /><~..~ <br />6 <br /> <br />
