Council Minutes of 8/3/99 <br />departments since debt service on borrowed money does impact the General Fund. <br />After those considerations and other discussion, the commission created a resolution <br />which supported the purchase of green space for the use by future generations in our <br />city and recommended the purchase of the Bradley Road green space provided the <br />purchase does not jeoyardize or interfere with anX other financial priority of the city- <br />• The final point of discussion was with regard to an issue that continually arises and <br />that is the lack of recreational space, in particular basketball space in the city. It was <br />discussed that the sports complex at the west end of the city would be investigated for <br />that purpose. This will be discussed again at a later date. <br />Mr. Gareau, chairperson of the Building, Zoning and Development Committee: 1) The <br />committee met on June 21, 1999 in Council Chambers. Present were committee <br />members McKay, Gareau and Miller; Councilmen O'Grady and Nashar; Assistant <br />Building Commissioner Rymarczyk, Assistant City Engineer McDermott; former <br />Council president Dewey Limpert. Agenda items were as follows: <br />• Ordinance 99-77, which reads "An ordinance creating new and revised Section <br />1126.02, 1161.12 and 1161.121 of the North Olmsted Zoning Code relating to <br />commercial lighting structures." A companion ordinance, 99-79, reads: "An <br />ordinance creating Chapter 556 of the General Offenses Code of the City of North <br />Olmsted entitled `Lighting Nuisance Control' and declaring an emergency." <br />Ordinances 99-77 and 99-79 were first introduced and discussed several years ago. <br />The ordinances would establish criteria for lighting fixtures and lighting schemes in <br />commercial districts throughout the city. They would also further prohibit nuisance <br />lighting, which Council is familiar with as of late with some residents who have <br />complained about spill-over lighting onto their property. This type of problem has <br />gone on for some period of time and is not new to the city. The committee agreed <br />that it would be appropriate and practical to more clearly enunciate the standards that <br />we have in our Building Code and to present and formally codify our practices that <br />we have used in the past in a clear, presentable form. That does not exist as it is at <br />this date. As such, the committee agreed that lighting standards and nuisance lighting <br />should be addressed and some sort of control should be adopted. .However, the <br />committee agreed to hold these two ordinances in committee so as to consult with Mr. <br />Tallon of the Planning Commission who some years ago presented this to Council as <br />well as First Energy Corporation and any person who might be interested in <br />discussing these matters and who might be affected. At least two landowners have <br />contacted Mr. Gareau wishing to address the Council committee on these concerns. <br />• Ordinance 99-82 which reads: "An ordinance creating new Section 1126.08 of the <br />Zoning Code of the City of North Olmsted entitled `Deviations from Approved Plans <br />Prohibited' in order to provide for better remedies against commercial and other <br />developers who, in constructing buildings and other improvements to land, deviate <br />from plans approved by the city, as amended." The committee discussed the on- <br />going problems associated with developers who, when appearing before City Council <br />and various city boards and commissions, make representations about their project <br />and then actually fail to carry those representations out.
