Council Minutes of 3/16/99 <br />REPORTS <br />Law Director Ga.reau: 1) With respect to the North Olmsted vs. Rollins case, the <br />damaged fire hydrant on Columbia Road, two insurance companies have paid the city the <br />entire amount. (Approximately $3,600) The money has been passed on to the Finance <br />Department. <br />2) With respect to a claim against the city by Nationwide Insurance and Kings Path <br />Condominium because of a deposit made to the Finance Department by mistake, during <br />our negotiation process Nationwide Insurance and Kings Path were demanding that the <br />interest from August until February be paid to them. We have negotiated an agreement <br />with Nationwide and Kings Path to waive any claim for interest and have returned the <br />money that was being held in escrow. <br />3) We had previously filed a motion for summary judgment in the Chamber of <br />Commerce case and received not only the brief in opposition but also across-motion for <br />summary judgment. Originally we were given fourteen days to brief that and file a <br />response. But because they have filed across-motion for summary judgment, we will ask <br />the court for an extension to brief that issue. <br />4) The Parcel E case has been reset for June 15. <br />5) The attorney for Mr. Link has informed the Law Department that the case is being <br />dismissed. (Defamation of character case where we had informed the attorney that it was <br />a frivolous claim.) <br />Mrs. Kasler, Chairperson of the Recreation, Public Parks and Buildings Committee: 1) A <br />joint meeting of the Recreation Commission and Council's Recreation Committee was <br />held on March 8. Present were committee members Miller, Limpert and Kasler; <br />Councilmen Gareau, McKay, O'Crrady; directors Copfer, Jenkins, Bohimann; Rec <br />Commissioner Todd Morgan; commission members Claire Hayes, Tim Smith, Bob <br />Kasler and secretary Pat Scott. This joint meeting was called as a result of the <br />commission's concern over the funding of recreation in general as well as specifically the <br />appropriations for recreation for 1999. The commission feels that the Rec Center itself <br />has pressing needs that have not been addressed in the budget appropriations. The <br />concern is that the aging facility is under-funded and that the result will be a loss in <br />revenue. It was brought to Council's attention that two rink compressors are <br />malfunctioning, mulch is needed for safety zones in playground areas, there are and have <br />been leaks in the tennis area roof and the wall in the outdoor pool is in need of immediate <br />repair. All of this has remained unfunded despite the decision not to replace a <br />bookkeeper and the possible intention of not to replace one other position. Furthermore, <br />a much needed additional supervisor has not been funded as yet. This is not unique, there <br />have been some mandatory cuts in other departments as well. However, the Recreation <br />Commission is focusing on this one department since that is its responsibility. As a result <br />of these discussions, the commission and the committee made the following requests and <br />choose to address this in a general long-term proposal as opposed to disputing any <br />appropriations at this time: <br />• A request was made of Mrs. Copfer to inform the commission and committee of the <br />amount of available funds once the present debt service ceases.
