Council Minutes of 3/2/99 <br />~ Mr. Nashar, Chairperson of the Public Safety, Health & Welfare Committee: 1) This <br />:,,~ evening the Public Safety Committee met to discuss a stock transfer for a liquor permit <br />located at 24108 Lorain Road, DBA Slam Jam's. The proposed transaction would <br />transfer 300 shares from Gary R. Brooks to his mother, Lois J. Brooks, thus bringing her <br />total shares to 600. Mr. Nashar moved that Council have no objection to a stock transfer <br />for a liquor permit located at 24108 Lorain Road, DBA Slam Jam's. The motion was <br />seconded by Mr. Gareau and unanimously passed. <br />Mr. McKay, Chairperson of Streets & Drainage Committee: 1) The Streets & Drainage <br />Committee met on Tuesday, February 23. In attendance were committee members <br />McKay, Nashar and O'Grady; Council members Kasler, Miller, Limpert and Gareau; <br />Council President Saringer; Mayor Musial; directors of Finance, Service and Safety. The <br />committee discussed Ordinance 99-21, which authorizes the Service Director to advertise <br />for bids for the construction of catch basin, manholes, sidewalks, curbing, pavement and <br />street lighting at various locations in the city and requesting that the Mayor contract for <br />the same. The committee recommended passage of Ordinance 99-21. <br />AUDIENCE PARTICIPATION <br />Bill and Ellie Gabriel, 25420 Clubside Drive, #5 in the Country Club Condominiums. <br />First, Mr. & Mrs. Gabriel wished to thank the administration and all the members of <br />Council for the opportunity to speak on a matter they consider important. They have <br />given Council a copy of letters sent to their Country Club Condo Association dated <br />12/24/98 and a copy of a letter sent to Mr. Bernard Marcus, CEO of Home Depot, <br />Atlanta, Georgia. Both letters were in regard to their displeasure with the buffer zone <br />behind their condo unit in the rear of the newly opened Home Depot store. This <br />afternoon, Mr. Gabriel had a telephone conversation with Mr. Greg Barrow, vice- <br />president in charge of development for Developers Diversified. They talked about the <br />buffer zone and that Mr. & Mrs. Gabriel would like to see the fence completed. There is <br />no fence behind the Gabriel home, which is right behind Home Depot. Mr. Barrow said <br />that Home Depot will pick up the cost of completing the fence as a good neighbor <br />gesture. Regarding the sign on the back of the building (referring to Ordinance 95-117), <br />Mr. Gabriel suggested that Council consider adjusting the hours for allowing deliveries, <br />pick-ups and running of engines. (Mr. Gabriel believes that the ordinance restricts this <br />activity from 8 p.m. to 7:30 p.m.) Home Depot opens at 6 a.m., and tow motors are often <br />operating that early in the morning. They would like the morning time to be amended to <br />read 8:30 a.m. They would also like to see this ordinance strictly enforced and encourage <br />the Law Director to send the Home Depot store manager a letter stressing the facts <br />contained in this ordinance so that he can bring them to the attention of the appropriate <br />department heads within his store. Mr. & Mrs. Gabriel extended their personal thanks to <br />Councilman Dean McKay for his help in bringing about a solution to their problem. <br />Mr. Nashar noted that Ordinance 99-11, which was recently passed, does stipulate that <br />tow motors, payloaders, backhoes and similar motorized vehicles used for loading and <br />loading within 175 feet of residential property are restricted to 9 p.m. to 8 a.m. Mr. <br />Gabriel said they would compromise with 8 a.m. but felt 7:30 a.m. was too early. <br />6 <br />j <br />
