Council Minutes of 2/2/99 <br />committee will review, study, and make recommendations in all possible aspects of <br />municipal government and development including, but not limited to, the <br />development of a golden triangle, a new library, a new fire station, a community <br />performing arts theater, bike trails, nature trails, green space acquisition and <br />utilization, zoning, rezoning, transportation, roads, environment, infrastructure and <br />recreational needs with a goal of providing the Mayor with a committee report in <br />October of 2000. <br />• No limits have been placed on the scope of the steering committee's activities. They <br />are limited only by the dynamics of their synergistic creativity. <br />Law Director Gareau: 1) On January 29, the Law Department filed a motion for <br />summary judgment in the Chamber of Commerce case. The court granted the city the <br />right to extend the brief from 30 pages to 50 pages, and the brief has been filed with the <br />federal district court. <br />2) Regarding the case of the supposed improper synchronization of the light at Country <br />Club Boulevard and Great Northern Boulevard, insurance counsel filed a motion for <br />summary judgment and it was granted. <br />3) The attorney for Mr. Biskind submitted a public records request. The Law Department <br />notified the attorney that he had asked the wrong people the wrong questions and would <br />need to redefine what he was looking for. Also, anything in the possession of the Law <br />Director is protected. <br />4) Regarding the Chamber of Commerce case, the attorney failed to appeal the Sunnyside <br />request for a variance on signage. He then requested that Sunnyside Toyota be put back <br />on the agenda for the BZA to receive a variance for pole signs. Approximately a year <br />ago, the city reached an agreement with the Chamber of Commerce staying any <br />proceedings dealing with the enforcement of the pole sign ordinance. Consequently, we <br />sent back the check received from Sunnyside and took them off the agenda because of the <br />signed journal entry by the federal judge indicating that everything is stayed. It makes no <br />sense to have them come back and ask to be put back on the agenda solely for the <br />purpose of establishing a legal right and pursuing what's called a 2506 appeal. <br />5) With respect to Parcel E, we have received some responses to the discovery that was <br />sent out. However, many things were not answered and many documents were not <br />produced. The Law Department has passed along the expert reports received from our <br />planner and appraiser. <br />6) With respect to the Parcel E tree ordinance case, the trial has been set for March 1. <br />7) Regard the Fiai case, Assistant Law Director Dubelko has met with insurance counsel <br />and the five police officers who were sued. We are developing a strategy with respect to <br />that case removing it from the state court to the federal court system. <br />Finance Director Copfer: I) At the last Council meeting, former Finance Director Jim <br />Burns expressed his concern that his comments were conspicuously absent from the audit <br />report. However, the State Auditor's office has confirmed that these comments are no <br />longer included in the published reports. <br />2) Councilman Gareau and Assistant Law Director Dubelko, with her input, have drafted <br />an ordinance which more clearly defines the accruing and payment of vacation benefits <br />for non-bargaining employees.
