Council Minutes of 11/8/2000 <br />,a.,, Ordinance 2000-137 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing the Director of Public Service to extend for three months a lease <br />agreement for a portable, complete dewatering centrifuge system for the Wastewater <br />Treatment Plant, without public bidding, and declaring an emergency. Councilman <br />McKay moved to suspend the rule requiring three readings; second by Councilman <br />O'Grady; passed unanimously. Councilman McKay moved for adoption; second by <br />Councilman O'Grady. Roll call: McKay, yes; O'Grady, yes; Nashar, yes; Miller, yes; <br />Limpert, yes; Gareau, yes, with comment that on July 18 Ordinance 2000-19 was <br />introduced by Mayor Musial and passed unanimously. At that time, he cast the one vote <br />against the suspension of the rules and he stated that, although he supported the project <br />and did vote to go ahead with the lease, he felt that perhaps more public discussion was <br />needed on the project since the three month rental was $130,000 and the machine could <br />possibly be purchased for $250,000. He continues to support the project, but thinks it is <br />important to note that we must make certain that we are doing it effectively and always at <br />the right price. It is important to do this correctly and at an appropriate pace. The motion <br />passed unanimously. Ordinance No. 2000-137 adopted. <br />Ordinance No. 2000-138 introduced by Mayor Musial was given its second reading. An <br />ordinance authorizing the Director of Public Service to enter into negotiations for <br />possible purchase of the leased portable, complete dewatering centrifuge system for the <br />Wastewater Treatment Plant, without public bidding, and declaring an emergency. <br />Councilman McKay moved for suspension of the rules; second by Councilman Limpert; <br />passed unanimously. Councilman McKay moved for adoption and commented that <br />Council did not rush into this decision. The Finance Committee investigated every <br />possible source to reduce the cost of doing this mindful of the fact that the citizens living <br />in that area needed relief. The people who have waited 30 years to get a problem solved <br />are not really worried about the cost of doing business. However, it is Council's <br />obligation to investigate every possible alternative, which has been done. Mr. Limpert <br />seconded the motion. At this point, Law Director Gareau interrupted the proceedings to <br />explain that this legislation could not be passed under suspension of the rules or with an <br />emergency provision as it is a capital purchase. Councilman McKay withdrew his <br />motion, and Councilman Limpert withdrew his second. The ordinance was given it <br />second reading. <br />Ordinance No. 2000-140 introduced by Councilman Nashar was given its second reading. <br />An ordinance creating new Section 1139.13 of Chapter 1139 of the Zoning Code, entitled <br />"Masonry Brick Required in Construction of Exterior Walls of Commercial Buildings," <br />so as to require that all new commercial buildings in the General Retail Business District <br />have exterior walls with a certain amount of masonry brick. <br />Resolution No. 2000-141 introduced by Councilwoman Kasler was given its second <br />reading. A resolution re-authorizing a Citizens' Committee created by Resolution <br />No. 98-96 for the purpose of gathering and presenting to Council projects for the city's <br />Community Development Block Grant (CDBG) applications, and declaring an <br />emergency. <br />12 <br />
