r <br />Council Minutes of 10/17/2000 <br />4) Springvale will have an open house on Sunday, October 29 from Noon until 5 p.m. <br />Complimentary hors d'oeuvres and beverages will be served. Everyone is welcome to <br />come and see the many improvements to Springvale, such as the new parking lot and <br />ADA compliant rest room facilities. <br />President Saringer complimented Safety Director Jenkins on the "new look" of his report <br />to Council. It really makes you want to stop and read it! <br />Law Director Gareau: 1) This past week, the final brief in the Parcel E case was filed. <br />The next step will be to have the issue set for final argument. He feels very good about <br />the case and looks forward to the final argument as well as a reversal of the lower court's <br />opinion. <br />2) The final paperwork on the Chamber of Commerce case has been received. The case <br />is now concluded. <br />3) Negotiations with employee unions have begun, with the Police Department being the <br />first group. He has received a packet from the FOP and will be participating in choosing <br />a fact finder in the near future. <br />4) A new lawsuit, which is an offshoot of an old lawsuit, has been received. This is in <br />regard to the jail hanging case which was removed to federal court with appended state <br />claims. Our insurance counsel filed a motion for summary judgment which was granted. <br />The court then dismissed without prejudice the appended state claims and those claims <br />are now back in the state court where the insurance counsel will represent the city. <br />Finance Director Copfer: 1) On Thursday, October 12, the Auditor of State had apre- <br />proposal briefing for the audit contract to go out to independent accountants. Six <br />independent public accountant firms had representatives there. The due date for that <br />proposal is October 26 at 4 p.m. at the Auditor of State's office in Cleveland. Then the <br />process is that she and the senior auditor from the State Auditor's office will evaluate the <br />accounting firms' completed questionnaires. The prices associated with the proposals <br />will also be evaluated. Then she and the senior auditor will make a recommendation to <br />the selection committee in Columbus who will award the contract. (The independent <br />public accounting firm and the State Auditor's office are the contracting parties.) <br />Mrs. Kasler, chairperson of the Intra-Governmental Relations and Legislation; Long- <br />Range Planning Committee: 1) The committee met on October 9 to discuss Ordinance <br />2000-133. Present were committee members Kasler, Nashar and Miller; Councilmen <br />Gareau, McKay, Limpert and O'Grady; President of Council Saringer; Assistant Law <br />Director Dubelko, Safety Director Jenkins and Mayor Musial. Ordinance 2000-133 <br />authorizes the City of North Olmsted to enter into the Northeast Ohio Public Energy <br />Council of Governments and the execution and delivery of the agreement establishing <br />such Council for the purpose of jointly establishing and implementing an electricity <br />aggregation program. This will allow North Olmsted to work jointly with political <br />subdivisions that have authorized electricity aggregation programs in their respective <br />jurisdictions for the benefit of group pricing. Deregulation will be effective in Ohio in <br />January, and this ordinance allows North Olmsted to group with other municipalities to <br />attempt to obtain lower electricity costs.
