• Council Minutes of 9/19/2000 <br />Call: Kasler, yes; Miller, yes; Limpert, yes; McKay, yes; Gareau, yes; Nashar, yes; <br />` O'Grady, no, with comment that he did not recall this legislation would be passed under <br />suspension of the rule. His concern with the ordinance is that, if the legislature should <br />choose to pass this ordinance, they are taking away the latitude of the trial judge. The <br />trial judge would no longer have the ability to determine what minimum sentence perhaps <br />was appropriate in what specific case. He would have liked to have had the assessment <br />of a couple of trial judges first; therefore, his vote on suspension is no. President <br />Saringer noted that the legislation was on the revised request for suspension. The motion <br />passed with six affirmative votes and one negative vote. Mrs. Kasler moved for <br />adoption; second by Mr. Miller; motion passed unanimously. Resolution No. 2000-116 <br />adopted. <br />Ordinance No. 2000-118 introduced by Mr. Miller on behalf of himself and Council <br />Members Kasler and Gareau was given its second reading. An ordinance creating new <br />Section 1139.12 of Chapter 1139 of the Zoning Code, entitled "Irrigation of Landscaped <br />Areas," so as to require that all landscaped areas located on parcels of Land within the <br />General Retail Business District be serviced by underground irrigation systems. <br />Resolution No. 2000-119 was introduced and placed on first reading by Mr. Limpert. A <br />resolution authorizing the Director of Public Service to advertise for bids for lighting <br />improvements at Ball Diamond Number Two at North Olmsted Park as detailed in the <br />plans and specifications on file and authorizing the Mayor to contract for the same, and <br />declaring an emergency. <br />Resolution No. 200-121 was introduced and placed on first reading by Mr. McKay. A <br />resolution directing the Auditor of Cuyahoga County to pay to the City of North Olmsted, <br />Ohio, during the year 2001, all money due and owing said city from any collection <br />sources. <br />Resolution No. 2000-122 was introduced and placed on first reading by Mr. McKay. A <br />resolution extending support for the purpose of increasing funding in the area of research <br />and treatment of dementia and Alzheimer's disease, and declaring an emergency. Mr. <br />McKay moved for suspension of rules requiring three readings and committee review <br />because this issue is coming before the legislature in September; second by Mr. O'Grady. <br />The motion passed unanimously. Mr. McKay moved for adoption; second by Mr. <br />Gareau; motion passed unanimously. Resolution No. 2000-122 adopted. <br />Ordinance 2000-123 was introduced and placed on first reading by Mayor Musial. An <br />ordinance establishing the organization of the Fire Division of the Department of Public <br />Safety, and declaring an emergency. <br />Resolution 2000-124 was introduced and placed on first reading by Mayor Musial on <br />behalf of himself and the entire Council. A resolution declaring November 11, 2000 <br />"Veterans Day." Mr. O'Grady moved for suspension of the rules requiring three readings <br />and committee review; second by Mr. Miller; motion passed unanimously.
