Council Minutes of 6/20/2000 <br />~<_ North Olmsted will retain, if not enhance, its competitive position in the regional <br />marketplace for years to come. For North Olmsted, this project will add jobs, improve <br />our all-important tax base and make the mall a more desirable place to shop. <br />Law Director Gareau: 1) The retaliation claim by Sunnyside Toyota was scheduled for <br />trial today. In preparation for the trial, many of the documents were gone over, prepared <br />and a trial brief was prepared. He spent most of yesterday interviewing and preparing <br />witnesses and worked into the evening. Previously, the Law Department had asked to <br />submit this issue on the basis of summary judgment. After the court discussed the matter <br />with counsel this morning, the judge suggested that, instead of trying the issue, it seemed <br />like there were more issues of law rather than fact and he set up a schedule for the issue <br />to be submitted on summary judgment. That should be completed sometime in August. <br />Hopefully, the judge will make a ruling on that issue and at the same time on the issue of <br />attorney's fees. <br />2) With regard to the library issue, the short presentation that was made earlier this <br />evening was the culmination of months of work on the part of the administration and <br />himself in attempting to make sure that, when we finally move forward, that we not only <br />will have the issues squared away with the library district but also many of the legal <br />issues will be accomplished in short order. There still is some work to do. This is a <br />subject that the citizens should look at very closely and is very desirable. <br />3) Apost-arbitration brief was submitted to the arbitrator yesterday in a case dealing with <br />the refusal to replace a secretary at the Senior Center. When the secretary retired, the <br />position of Activities Coordinator (a non-union position) was filled instead. Hopefully, a <br />favorable resolution will be received within the near future. <br />Finance Director Copfer: 1) On Thursday, June 8, the city sold $2.1 million in notes for <br />the capital improvement program for this year at a 5.4% interest rate. These notes are <br />going to be due September 23, which will match the maturity of last year's capital <br />improvement notes so that we have one issue out atone time. <br />2) The April revenue and expenditure reports and the first quarter investments May report <br />were delivered to Council today. <br />President Saringer reported on the Committee-of--the-Whole: 1) The meeting was held on <br />May 18 to discuss the issue of mass mailings. All members of Council were in <br />attendance. Because of a controversy regarding a letter that was mailed to a <br />Councilman's constituents, she had requested a legal opinion from the Law Director. All <br />but two Council members agreed with Mr. Gareau's opinion. Mr. Limpert preferred <br />Council mail to residents be restricted to responses to residents. However, broader <br />mailings could be sent with the approval of Council as a whole. The majority of Council <br />did not approve this idea. After a lengthy discussion, it was suggested that perhaps a <br />change in Council's Organization and Travel budget be made to divide it equally so as to <br />allow each person to use their allotment at their own discretion. She may call another <br />meeting in the future to work out this issue for next year's budget. At this time, the <br />majority agreed with the Law Director and no change will be made. <br />2 <br /> <br />
