MINUTES OF THE MEETING OF THE COUNCIL <br />,,,~ OF THE CITY OF NORTH OLMSTED <br />MARCH 8, 2000 <br />Present: Council President Saringer, Council Members Gareau, Kasler, Limpert, <br />McKay, Miller, Nashar, O'Grady <br />Also Present: Mayor Musial (took his seat at 8:35 p.m.), Law Director Gareau, Clerk of <br />Council Seman <br />Council President Saringer called the meeting to order at 8:10 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of <br />Allegiance to the Flag. <br />The minutes of the Council meeting of January 18, 2000 were approved as written. <br />REPORTS <br />(Please see Miscellaneous Business for the Mayor's report.) <br />Law Director Gareau: 1) The Law Department received a motion for interim attorney's <br />fees filed on behalf of the Chamber of Commerce dealing with the sign code case. The <br />motion is currently being reviewed and an appropriate response will be made. It should <br />also be noted that, as reported previously, there is one peripheral issue that remains on the <br />Chamber of Commerce case that needs to be litigated on the 15~' of April and that deals <br />with an alleged retaliation claim. This is currently being reviewing in anticipation of <br />filing a dispositive motion. <br />2) A complaint was received from Olmsted Township regarding the annexation proposed <br />by Mr. Rocco Puzzitiello. The complaint seeks an injunctive relief regarding the adoption <br />of a petition for annexation. The trial court refused to grant a temporary restraining <br />order, which would have put the City of North Olmsted Council in the position to adopt <br />the ordinance that was on the agenda this evening. However, a motion was immediately <br />filed in the Court of Appeals and the Court of Appeals did issue a stay with respect to the <br />ability of the city to adopt that ordinance. Thus, that ordinance that was removed from <br />the agenda in caucus. <br />3) The Law Department, since the last Council meeting, worked a great deal to come up <br />with a new sign code. The code that currently is in front of Council, with two minor <br />exceptions, has incorporated most of the- suggestions of the Planning Commission and <br />was amended by this Council prior to its second reading. When it appears this evening <br />on its second reading, it will be as amended including some of the suggestions of the <br />Planning Commission. <br />
