Council Minutes of 3/8/2000 <br />LEGISLATION <br />Ordinance No. 99-82 introduced by Mr. Gareau was given its third reading. An <br />ordinance creating new Section 1126.08 of the Zoning Code of the City of North <br />Olmsted, entitled "Deviations from Approved Plans Prohibited," in order to provide for <br />better remedies against commercial and other developers who, in constructing buildings <br />and other improvements to land, deviate from plans approved by the city, as amended. <br />Mr. Gareau moved for adoption; second by Mr. Nashar; motion passed unanimously. <br />Ordinance No. 99-82 adopted. <br />Ordinance No. 99-109 introduced by Mr. Miller was given its third reading. An <br />ordinance creating new Section 1139.13 of the North Olmsted Zoning Code regulating <br />the outdoor, unenclosed storage of motor vehicles at motor vehicle repair facilities. Mr. <br />Miller moved for adoption; second by Mrs. Kasler. Roll call: Miller, yes; Kasler, yes; <br />Gareau, yes; Limpert, no, with comment that he appreciated the concern for junk vehicles <br />that this is trying to address. But Ordinance 99-109, in effect, is going to create mini- <br />junkyards at all the repair facilities. Out of sight, out of mind seems to be the motto of <br />this. That doesn't mean there isn't still a problem on those sites. Currently, we have <br />Section 521.08 which requires junk vehicles be stored inside after seven days. Why <br />should we change it to forty-five days and then, rather than having the cars stored inside, <br />stored within a fence? These fenced areas will become havens for old tires, exhaust <br />systems, parts cars, cats and wild animals. Stored tires will create water basins for <br />mosquitoes. The ordinance does not call for any criterion on these fenced-in areas, what <br />the setbacks will be, what type of materials they will be, how tall they will be, whether <br />they will be big enough for one, two, ten or a hundred cars. This problem could be <br />addressed in a much more beneficial way. Ugly cars are ugly and ugly fences are ugly <br />also. Roll call continued: McKay, yes; Nashar, yes; O'Grady, no, with comment that he <br />has significant concerns with this piece of legislation, and a lot of it is exactly the same as <br />what Councilman Limpert described. We would not want someone to come into the city <br />and build afenced-in area to store junk cars. With this piece of legislation, all someone <br />has to do to accomplish the same thing is to store two junk cars outside. Then he gets to <br />build a fence, and we have junk cars inside a junk fence, which is a bad idea. The motion <br />passed with five affirmative votes and two negative votes. Ordinance No. 99-109 <br />adopted. <br />Ordinance No. 2000-2 introduced by Mayor Musial was given its third reading. An <br />ordinance to transfer funds from the Bus Fund to the General Fund in the amount of <br />$32,411 for materials and parts reimbursement funds received from the Greater <br />Cleveland Regional Transit Authority in the 1997 and 1998 annual audits of the North <br />Olmsted Municipal Bus Line, in which these materials and parts were owned by the City <br />of North Olmsted and declaring an emergency as amended.
