Council Minutes of 9/18/2W1 <br />~, of intoxicating liquor on Sunday between 1 p.m. and midnight. These DS and D6 <br />licenses are from Apple America. Limited Partnership of Ohio, DBA Applebee's to <br />Apple Ohio LLC, DBA Applebee's. There were no objections to this transfer, and <br />the committee unanimously recommended approval. Mr. O'Grady moved that <br />Council approve the DS and D6 liquor license transfer to Apple Ohio LLC, DBA <br />Applebee's. The motion was seconded by Mr. Limpert and unanimously approved. <br />Councilman Dailey, chairperson of the Transportation Committee: 1) The Transportation <br />Committee met on September 13. In attendance were committee members Dailey, Kasler <br />and O'Grady; all other members of Council including the Presidern of Council; Service <br />Director Bohlmann, Safety Director Jenkins, Finance Director Copfer and Traffic <br />Engineer Crriffith. Up for discussion was Ordinances 2001-102, an ordinance authorizing <br />the Mayor of the City of North Olmsted to enter into an agreemern with Traff--Pro <br />Consultants Inc. to provide design services for the Dover Center Raad and Driscoll <br />Lane/Cottonwood Trail intersection traffic signal system and declaring an emergency. <br />Also discussed was Ordinance 2001-103, an ordinance amending the Traffic Cornrol File <br />for the City of North Olmsted to provide for the installation of a traffic signal system at <br />the intersection of Dover Center Road and Driscoll Lane/Cottonwood Trail and declaring <br />an emergency. Discussion centered around the need for the traffic light in the described <br />area and the safety of the students in and around the area of Pine School. Urnil further <br />clarification from the Law Department is received, the ordinance will proceed as written <br />on second reading. <br />Councilman Nashar, chairperson of the Building, Zoning and Developmern Committee: <br />1) The committee met on September 13. Presern were committee members McKay, <br />O'Grady, Nashar; President of Council Saringer and Assistant Law Director Dubelko. <br />Agenda items were as follows: <br />• Ordinance 2001-109, an ordinance amending Section 1163.02, 1163.10, and 1163.15 <br />of Chapter 1163 entitled "Signs" of the Zoning Code so as to clarify the definition of <br />the word "Sign" as used in Chapter 1163 and further to provide for the removal of <br />abandoned signs and non-conforming signs the use of which has been voluntarily <br />discontinued. Under Section 1163.10 and 1163.15, this legislation will regulate non- <br />conforming signs which have been discontinued and/or abandoned. This ordinance <br />has been amended to increase the time period up to 6 mornhs, making this consistent <br />with the State of Ohio Revised Code under Section 713.15. In Section 1163.02, the <br />Law Department has made recommendations for amendments to the definition of the <br />word "Sign." Under Section 1163.02 (a), the word "pole" will be removed from the <br />definition of the word "Sign." The committee recommended approval of Ordinance <br />2001-109, which will require a public hearing. <br />• Ordinance 2001-108, introduced by Councilman Miller, amends Section 149.02 and <br />1123.09 of the Zoning Code to establish a clear procedure for notice to be given to <br />condominium property owners affected by proposed developments and requirements <br />for variances. This ordinance was amended and broken down into two ordinances. <br />The two issues were separated for clarity as they affect two different codes. The <br />amended Ordinance 2001-108 amends Section 1123.09 of the Zoning Code in order <br />6 <br />1 <br />
