Council Minutes of 5/15/2001
year. The past service of the BFI has been very good and the committees recommend
approval.
Mrs. Kesler made a motion to amend Ordinance No. 2001-55 to add in Section 1 the
words "on school days only"; to add "on school days only" to Section 2 after the hours;
to place the "hours" and "on school days only" language in the caption as well as in the
first whereas. The motion was seconded by Councilman Limpert. Roll call: Kesler,
yes; Limpert, yes, with comment that he vehemently disagrees with Ordmance 2001-55.
If there is a safety issue, he thinks we should be staying with the current program.
However, if he is wrong and it is not a safety issue, then it makes sense for this
amendment. Roll call continued: McKay, yes; Dailey, yes; O'Grady, yes; Nashar, yes.
Miller, yes. The motion passed unanimously. Mrs. Kesler noted the amendment would
place the legislation back on second reading but she planned to ask for suspension of the
rule.
AUDIENCE PARTICIPATION
Patricia Deis, 26893 Sweetbrier Drive, wished to advise Mr. O'Grady that his comments
about Mrs. Kasler's remarks were wrong. When she and others brought the problem
(Pine SchooUSweetbriaz pazking) to Council fifteen months ago, they were not concerned
with the convenience of the people who had the signs in their yazd. That was never an
issue, and it was never presented as convenience for the residents. The issue was brought
up strictly as a measure of safety for the children. Also, she does not agree with Mr.
O'Grady's statement that cazs will be able to park their bumper on the safety crosswalk
because that would block the two adjacent driveways. In view of the failure of the school
levy, it is appazent to her that there is not going to be a solution from the school board.
What they have asked for in this ordinance is an extra layer of protection for the children.
This is not and never has been for the convenience of the residents. The word
"convenience" came up when it was stated that the people who were in violation of the
current ordinance were doing it for their convenience. She and her neighbors have done
everything in their power to ensure that the children's safety has been the foremost issue.
She feels this issue would have been resolved long ago if not for dissension on the
committee. Mr. O'Grady said he did not agree with Mrs. Deis' comments about no
progress. The Council cannot direct the schools to take the cars off of Sweetbrier and put
them in the Fine parking lot. He believes that the ordinance is increasing the hazard to
children. He also does not agree that the ordinance is being considered because of
pressure by the residents.
Sandy Weir, 26898 Sweetbrier Drive, said that the driveway being discussed belongs to
her and a car cannot be pazked on the edge of the crosswalk without hanging over into
her driveway. She has lived there for 24 yeazs, and the only problem occurs before and
after school with 30/40 cazs dropping off and picking up children. Sweetbrier is not
anymore an exciting street than anywhere else-cazs aze not parked there constantly.
Also, once school is over, the children are not interested in going over to Pine. If they do
go there, they do not go to the crosswalk but rather cross wherever they feel like it. She
~"'' does not understand why some people think it is such a problem to occasionally have
11
