Council Minutes of 2/6/01 <br />~ volunteers his time teaching chess to students at Maple School and tutoring students in <br />~;~ math. He also vohmteers at Fairview Hospital. <br />3) Recently, a resident who was concerned about water rates asked about the possibility <br />of forming a partnership with neighboring cities who have their own water system. <br />(Avon Lake for example.) Our Environmental Engineer, Dennis Long, looked into this <br />and has indicated that there would be a question of capacity and supply. Also, there is <br />the cost of constructing water lines from North Olmsted to the other city. As soon as all <br />the information is gathered, it will be passed along to Council members. <br />4) With regard to the electric deregulation, NOPEC is still in heavy negotiations with two <br />potential suppliers, Green Mountain from Texas and AEP from Columbus, Ohio. <br />Hopefully, the announcement will be made in the middle of February. Following that, <br />informational letters will be sent to North Olmsted residents giving them the opportunity <br />to opt-out. <br />Assistant Law Director Dubelko: 1) On January 18, the Law Department filed a brief <br />with the American Arbitration Association in connection with the dispatcher grievance <br />over the appropriate rate of pay for the dispatchers in the city who work overtime on <br />holidays. The American Arbitration Association has indicated that a decision would be <br />made by the arbitrator within 30 days. <br />2) The Law Department has provided a written legal opinion to the Civil Service <br />Commission regarding the applicability of Civil Service visual acuity standards for fire <br />fighter applicants. <br />3) A written legal opinion was provided to the Building Department concerning the new <br />FCC regulations which limit the zoning authority of the city over local fixed wireless <br />telephone companies. Recently, Teligent had applied to provide this service to the two <br />tech park buildings on Country Club Boulevard. The FCC amended its OTARD rules to <br />treat these type of antenna in the same fashion as home satellite dishes. When that <br />regulation initially went into effect, the City of North Olmsted, upon the recommendation <br />of the Building Department, opted not to regulate those and to make them exempt from <br />our local regulations. Council may wish to do the same thing with respect to the antennas <br />for organizations like Teligent. It should be noted that this rule applies only if the <br />antenna or dishes are a meter or less in diameter. <br />4) Pursuant to the authority granted by Council, the Law Department has sent <br />correspondence to all the property owners of land where the new library is proposed to be <br />built to offer to purchase the properties for their appraised values. The city has obtained <br />appraisals on all of those properties. None of the offers have yet been accepted. Law <br />Director Gareau has had some preliminary discussions with a number of the property <br />owners. The Law Department is in active negotiations with an attorney representing the <br />owner of the lumber yard property. <br />5) The Law Department has issued a written legal opinion to the fire chief regarding the <br />right of union representatives to be present at management meetings at the fire station. <br />b) On January 30, a representative of the Law Department attended a Council committee <br />meeting to provide legal advice in connection with an important pending piece of <br />legislation, Ordinance 2001-05, which is the community access to city media ordinance. <br />7) The Law Department has provided a written legal opinion to the Building Department <br />on the applicability of the Ohio Basic Building Code to repairs at the post office in North <br />2 <br />
